Prosecutors in China only appear in criminal cases?

The main legal business of China's procuratorial organs can be divided into seven categories, namely, public prosecution, investigation and supervision, anti-corruption, anti-dereliction of duty and infringement, civil administration, accusation and complaint, and prison.

In these major legal business departments, public prosecution, investigation and supervision belong to criminal litigation, anti-corruption and anti-blasphemy belong to duty crime investigation, accusation and complaint belong to complaints, reports, letters and visits, prisons belong to penalty supervision, and the People's Bank of China belongs to the only civil administrative litigation supervision business.

Prosecutors in China can play the role of supervisors in civil trials and administrative proceedings. Their main job is to review the civil and administrative judgments that have come into effect. If a case that meets the requirements stipulated in the Civil Procedure Law and the Administrative Procedure Law is found, it may lodge a protest and go to the retrial court for litigation supervision. In essence, the power of foreign prosecutors is similar to that of China. They appear as prosecutors on behalf of the country, which is one of the most important businesses of prosecutors all over the world. Slightly different, prosecutors in some countries have the right to investigate ordinary criminal cases and can intervene in criminal cases they think are necessary (for example, in the United States, American prosecutors can even intervene in civil cases they think are necessary at will). In China, prosecutors only have the right to directly investigate duty crimes and criminal cases under the jurisdiction of the procuratorate according to individual laws. Some countries have the command power of criminal investigation, which can direct the police to investigate criminal cases (that is, "guiding investigation", representing the country is Britain), but China's procuratorial organs are still exploring this kind of business. Prosecutors in common law countries are relatively independent and can carry out procuratorial work in their personal capacity, so there is generally no such department as "procuratorate", which is generally called "procuratorate" and belongs to the Ministry of Justice, which is different from the fact that procuratorial organs in China are national judicial organs.

Hong Kong belongs to the Anglo-American legal system, and the status and role of prosecutors are similar to those of Britain.
