Notarization of premarital property: refers to the definition of personal property before marriage or the same property after marriage by husband and wife or unmarried couples. That is to say, the notarization of premarital property refers to the activities of notarization institutions to prove the authenticity and legality of the agreement reached by couples (unmarried couples) on the scope and ownership of their premarital property and debts. The contents of the agreement concluded by both parties only involve their pre-marital property, not the property acquired by both parties after marriage. So it is called notarization of prenuptial property agreement.
The function of property notarization before marriage: it can clearly record the property status of husband and wife before marriage. Therefore, when a husband and wife divorce, they can prove that a property does not belong to the same property of the husband and wife through pre-marital property notarization, and there is no need to divide it.
Process:
Step 1: The parties need to prepare the following materials:
1, personal identification. Such as identity cards and household registration books, married people should also bring a marriage certificate. (Married people can make up for it).
2. Proof of property ownership related to the agreed content. Such as real estate license, purchase contract without real estate license, payment invoice, etc.
3. If both parties have drafted an agreement. The contents of the agreement generally include: the personal basic information such as the name, gender, occupation and address of the parties, the name, quantity, value, status and ownership of the property, and the principles for the use, maintenance and disposal of the above-mentioned premarital property. Generally, the signatures of both parties and the date of the contract are vacant, and the notary will sign in front of the notary after reviewing and amending the agreement.
Step 2: After preparing the above materials, both parties must go to the notary office for notarization in person and fill in the notarization application form. Entrusting others to act as agents or personally notarizing premarital property will not be accepted.
Step 3: After the notarization application is accepted by the reception notary, the notary asks the parties whether they have cheated or misled the contents of the property agreement, and checks the property right certificate. The parties should answer the questions truthfully. After signing the property agreement, the notary will fulfill the necessary legal obligation to inform the parties of their legal obligations and legal consequences. After the parties cooperate with the notary to complete the notarization transcript, they shall sign the transcript for confirmation.
Step 4: Both parties sign the prenuptial property agreement in front of the notary. At this point, the pre-marital property notarization procedures have been completed.
