General video access authority can only be the system of public security departments and security departments, and access must also be based on the need of performing official duties and handling cases, or for reasons such as national security and interests, and ordinary people cannot access it at will. As for the surveillance video in public places, the state has very clear regulations and it is not allowed to leak it easily.
According to the law, public security organs have the right to obtain relevant surveillance videos when handling cases, but they all have a set of standardized procedures, and generally they must hold the Notice of Obtaining Evidence.
The new law will clearly define "public voyeurism":
The year before last, a free live video website where surveillance cameras can be seen in many parts of the country caused a heated discussion. In Guangzhou alone, 185 surveillance cameras were broadcast live by the website. In addition to the surveillance video of public space, there are also live broadcasts of indoor scenes, including an adult goods store in Shaoguan, Guangdong. How to protect the public's privacy?
Zhang Shaowu, a lawyer of Guangdong Hongmian Law Firm, said that there are still some regulatory gaps in the installation of surveillance videos and the use of video content, and it is not clear who will manage social videos.
The provisions on the protection of citizens' privacy in Chinese laws, the General Principles of Civil Law and the Law on Public Security Administration Punishment all reflect the requirements of protecting citizens' privacy. Therefore, when accessing and using videos involving citizens, we need to consider whether it involves infringement of citizens' privacy.
The Regulations of Guangzhou Municipality on the Administration of Public Safety Video System (Revised Draft for Comment) also stipulates the new situation of "public voyeurism", strengthens the protection of personal privacy, and clearly stipulates that the construction, use and maintenance of public safety video system shall not reveal state secrets and commercial secrets, and shall not infringe on personal privacy and other legitimate rights and interests.
No unit or individual may buy, sell, illegally view, copy, acquire, disseminate or use the information of public safety video system.
