Fisher Peony Parrot, also known as Fisher Lover Parrot, Brown-headed Peony Parrot and Wild Peony Parrot, lives in the tropical jungle, belongs to the Treaty on International Trade in Endangered Species of Wild Fauna and Flora, and is also a national second-class protected animal. According to Article 341 of China's Criminal Law, anyone who illegally hunts or kills precious animals under special state protection, or illegally buys, transports or sells precious animals under special state protection and their products shall be sentenced to fixed-term imprisonment of not more than five years.
What friends may not even know is that in the judicial interpretation of National 200 1, all parrots belong to the second-class protected animals of the country, but not all of them. However, according to the 20 10 international convention, four kinds of parrots are no longer protected, including the common budgerigar, which we often say.
Some friends will also say that the businesses selling parrots in Shangqiu are all artificially domesticated parrots and should not be considered wild animals. Friends must know this, that is, the judicial interpretation stipulates that artificially domesticated wild animals are also called wild animals. It is said that no matter whether you catch wild parrots or raise them yourself, they are counted as wild animals.
The most classic case is the case of buying and selling parrots in Wang Peng. Wang Peng runs a pet shop, and two of the four parrots sold are wild animals under state protection. Wang Peng himself did not know that all parrots except four were protected wild animals, so according to the judgment of the court at that time, all of them were directly sentenced to five years' imprisonment.
Finally, because this case was reported to the Supreme Court, the sentence was lenient. Later, it was changed from five years to two years, because most people didn't know that parrots were national protected animals, which were counted before.
So from this case, we can see how precious parrots are in China. According to this statement, in fact, everyone had better not even keep parrots, which may violate the law, except budgerigars.
Although the Shangqiu businessmen in the title were held accountable, they certainly didn't know that parrots were protected second-class wild animals, and even if they were raised, they were wild. All subsequent accountability will be punished.
