The duration of several processes before the trial is:
1. The maximum criminal detention is 37 days;
2. The detention period for investigation after arrest shall not exceed 2 months; However, if the case is complicated and cannot be concluded at the expiration of the time limit, it may be extended by 1 month; In line with the provisions of Article 126 of the Criminal Procedure Law, it can be extended for 2 months; If the criminal suspect may be sentenced to fixed-term imprisonment of more than 10 years, the extension period may be extended for another two months according to Article 126 of the Criminal Procedure Law. If other important crimes are found, the time limit will be recalculated. In other words, it is not counted as recalculation, and the longest detention after arrest is 7 months.
3. After the investigation, if the case is transferred to the procuratorate for review and prosecution, the time limit is generally 1 month; Major and complicated cases can be extended for half a month; However, if the jurisdiction is changed, the procuratorate after the change shall count from the date of accepting the case;
Therefore, under normal circumstances, the suspect will be prosecuted to the court at the longest after being arrested for 8 months.
