It combines the "lawyer qualification examination", "initial judge qualification examination" and "initial prosecutor qualification examination" into one, and canceled the once popular examination that year. Three separate test items at the moment. Anyone with a bachelor's degree or above can register to take the exam. In addition, the examination does not specify the nature of the job performed by the applicant or the major studied. Both the Master of Laws and the Master of Laws are national academic education examinations, while the Judicial Examination is a professional qualification examination, which is different from the academic education examination. In other words, whether it is a master's degree in law or a master's degree in law, in order to obtain the qualification to practice, you must pass the judicial examination.
Application requirements:
Educational requirements: Bachelor degree or above in law from a higher education institution, or bachelor degree or above in other majors from a higher education institution and possess legal professional knowledge.
In other words, in principle, junior college students cannot apply for the National Judicial Examination. However, this year the Ministry of Justice stipulated that some areas where there is still a serious shortage of legal professionals will relax the academic requirements for judicial examination admissions. Legal majors will be allowed in the relaxed areas. Talented candidates apply for junior college students.
① Persons who meet the following conditions can register for the National Judicial Examination:
1. Have the nationality of the People’s Republic of China;
2. Support the Constitution of the People’s Republic of China ", enjoy the right to vote and be elected;
3. Have full capacity for civil conduct;
4. Comply with the "Judges Law", "Prosecutors Law" and "Lawyers Law".
5. Good conduct. Good conduct.
According to the "Opinions of the Ministry of Justice on Determining the Relaxation of the Academic Qualification Requirements for Registration for the National Judicial Examination" (Si Fa [2002] No. 2), the judicial administrative organs of autonomous counties (banners) may relax the academic qualification requirements for registration. No. 2), autonomous counties (banners) under the jurisdiction of provinces, autonomous regions and municipalities directly under the Central Government, counties (banners) under the jurisdiction of autonomous regions, counties under the jurisdiction of autonomous prefectures; counties approved by the State Council as key counties for national poverty alleviation and development work; cities and districts under the jurisdiction of the Tibet Autonomous Region , counties, county-level cities, and municipal districts, the academic requirements for registration can be relaxed to a junior college degree in law from an institution of higher learning.
The above-mentioned institutions of higher learning, according to the provisions of Article 68 of the Higher Education Law of the People's Republic of China, refer to universities, independently established colleges and colleges, including higher vocational schools and adult colleges.
Hong Kong, Macao, Taiwan and foreign higher education degree holders can apply.
② If you have any of the following circumstances, you cannot register to take the exam. If you have gone through the registration procedures, your registration will be invalid:
①. Those who have received criminal punishment for intentional crimes;
②. Have been dismissed from public service by a state agency or have had their lawyer's practicing certificate revoked;
3. In accordance with the provisions of Article 18 of the "National Judicial Examination Implementation Measures (Trial)", have been sentenced to 2 Those who have been sentenced to fixed-term imprisonment of less than 1 year are not allowed to register for the national judicial examination, and those who have not expired; or those who have been sentenced to life imprisonment are not allowed to register for the national judicial examination.
③ Persons who have obtained a Class A legal professional qualification certificate through the National Judicial Examination, and persons who have obtained a Class B legal professional qualification certificate but have not obtained a bachelor's degree or above from a college or university, are not allowed to register for the National Judicial Examination again.
