Article 3 Key pollutant discharge units listed as key pollutant discharge units for the atmospheric environment and water environment shall comply with relevant national and provincial standards, specifications and regulations. Article 4 The Provincial Department of Ecology and Environment is responsible for the unified supervision and management of automatic monitoring of key pollutant discharge units in the province. The municipal ecological environment department is responsible for the daily supervision and management of automatic monitoring of pollution sources within its own administrative region. , the Yangling Demonstration Zone in Xixian New District, Hancheng City is responsible for the daily supervision and management of automatic monitoring of pollution sources within its jurisdiction. Article 5: Key sewage discharge units shall install automatic monitoring equipment at the following sewage outlets: (1) ) For units that have been issued a pollutant discharge permit, the sewage discharge outlets specified in the pollutant discharge permit shall be automatically monitored, except for enterprises whose pollutants are disposed of by other enterprises or centralized sewage treatment facilities in the park. Article 6 For pollution source discharge outlets where automatic monitoring equipment is installed, the automatic monitoring plan shall be determined in accordance with the following provisions: (1) Where a pollution discharge permit has been issued. After the installation of automatic monitoring equipment is completed, key sewage discharge units should refer to relevant technical specifications to debug (test) and test run the automatic monitoring equipment, and report the automatic monitoring equipment to the ecological environment department within the specified time limit. Network and organize automatic monitoring and acceptance (including construction acceptance, instrument or equipment acceptance, technical indicator acceptance, and network acceptance). Automatic monitoring and acceptance of relevant acceptance contents (including construction acceptance, instrument and equipment acceptance or technical indicator acceptance, network acceptance, and operation and maintenance plan acceptance). From the date of passing the inspection, the pollutant-discharging unit can use the automatic monitoring data for the calculation of environmental taxable pollutant emissions, environmental information disclosure, and the preparation of pollutant discharge license execution reports. Key pollutant-discharging units shall report the automatic pollution source monitoring facilities to the competent ecological environment department for record within 5 working days after the automatic pollution source monitoring facilities pass the acceptance inspection.

Article 8 Key pollutant-discharging units shall regularly conduct daily inspection, calibration, verification and other maintenance work on automatic monitoring equipment in accordance with relevant technical specifications. When equipment fails, it should be repaired in time. Maintenance, fault repair and other operations should be recorded and kept in the automatic monitoring equipment station for reference, and the storage time should be no less than 1 year; if the automatic monitoring equipment needs to be shut down, dismantled or replaced, it should be Report to the competent ecological environment department for approval in advance; the main equipment or core components of the automatic pollution source monitoring facility are replaced to the sampling location or the main equipment installation location. If major changes occur, the inspection and acceptance should be reorganized and reported to the ecological environment department for record. If the automatic monitoring equipment stops operating or cannot operate normally due to equipment failure, inspection, maintenance, etc., and the automatic monitoring data is obviously distorted, the sewage discharge unit shall report to the ecological environment authority within 12 hours, report the reasons in writing, and ensure that the equipment is within 5 Normal operations will be restored within 1 working day. During the outage, sewage discharge units should be organized to carry out manual monitoring. The monitoring cycle interval of wastewater discharge outlets shall not exceed 6 hours, data shall be reported no less than 4 times a day, and the monitoring frequency of waste gas discharge outlets shall not be less than once a day. If a pollutant discharge unit carries out manual monitoring, its laboratory construction and operation should comply with relevant national standards; if it adopts the form of entrusted monitoring, it should entrust an inspection and testing agency with a qualification certificate to carry out environmental monitoring.

Article 9 The effective automatic monitoring data under normal operation of the automatic monitoring equipment network shall serve as the basis for the supervision and management of the ecological and environmental authorities. Automatic monitoring data can be used for environmental administrative penalties if they are identified by the competent ecological environment department and have an evidence chain with other relevant evidence. Among them, if the hourly average or daily average of automatic monitoring data exceeds the standard, it will be used as the basis for determining the illegal behavior of the pollutant discharge unit in exceeding the standard discharge of pollutants.

Article 10: If the on-site monitoring data commissioned by the ecological environment department is inconsistent with the automatic monitoring data of the pollutant discharge unit for the same period, and the on-site monitoring data meets the statutory monitoring standards and monitoring methods, the on-site monitoring data shall be given priority when judging pollutant discharge. The basis for whether the standard is met can also be used as a basis for judging whether the automatic monitoring equipment is operating normally. One of the basis for judging whether automatic monitoring equipment is operating normally.

Article 11 Shaanxi Province implements an electronic supervision system for automatic monitoring data that exceeds the standard (abnormality). If the daily average value of the automatic monitoring data exceeds the standard or is abnormal, the city and county ecological and environmental protection departments and key pollutant discharge units will be reported to the city and county ecological and environmental protection departments and key pollutant discharge units through the electronic supervision system. The supervisory contact sends electronic supervisory instructions. Municipal and county ecological environment authorities and key pollutant discharge units should conduct preliminary verification of the supervision content within 24 hours after receiving the supervision order. Within 5 working days, the municipal and county ecological environment authorities should comply with national and provincial laws and regulations. and document requirements to complete on-site evidence collection and related disposal work, and record and archive relevant information in the supervision system.

Article 12: After the automatic monitoring equipment of key pollutant discharge units is installed and connected to the Internet, it must comply with the environmental information disclosure requirements of enterprises and institutions of the Ministry of Ecology and Environment and the Provincial Department of Ecology and Environment, and pass the "Environmental Information Disclosure of Enterprises and Institutions of Shaanxi Province" Automatic monitoring data information is disclosed through "platform", municipal (district) ecological environment department publicity platform, corporate website, corporate factory electronic bulletin board, etc. The public information should at least include the name of the discharge outlet, monitoring date, pollutant types, hourly average (or daily average) of automatic monitoring data, pollutant emission limits, etc.

Key pollutant-discharging units should disclose automatic monitoring data information in real time, prohibit tampering, forgery, and screening of public data, and be responsible for the authenticity, accuracy, validity, and completeness of public data.

Article 13 If a key pollutant-discharging unit fails to install or use automatic monitoring equipment for pollutant emissions in accordance with regulations, fails to network with the ecological environment department or ensures the normal operation of the monitoring equipment, it shall be punished in accordance with the "People's Republic of China* Penalties specified in paragraph 2 of Article 82 of the Water Pollution Prevention and Control Law of the People's Republic of China or Article 100 (3) of the Air Pollution Prevention and Control Law of the People's Republic of China.

Article 14 If a key pollutant discharging unit discharges pollutants exceeding the permitted discharge concentration or permitted discharge volume, it shall be punished in accordance with the provisions of Article 34, Paragraph 1, of the "Regulations on the Administration of Pollution Discharge Licenses".

Article 15 If a key pollutant discharge unit discovers abnormalities in the transmission data of pollutant discharge automatic monitoring equipment or pollutant discharge exceeds pollutant discharge standards and other abnormal circumstances and fails to report, it shall be punished in accordance with Article 3 of the Regulations on the Administration of Pollutant Discharge Licenses. The penalties specified in Article 16, Item (8).

Article 16 If a key pollutant discharging unit fails to disclose pollutant discharge information in accordance with the provisions of the pollutant discharge permit or fails to truthfully disclose pollutant discharge information, it shall be punished in accordance with Article 36 (7) of the "Pollution Discharge Permit Regulations" Specify penalties.

Article 17 If a key pollutant-discharging unit illegally discharges pollutants by tampering or forging automatic monitoring data, or improperly operating pollution prevention and control facilities, etc. to evade supervision, it shall be punished in accordance with Article 34 of the "Pollution Discharge Permit Regulations" Penalties specified in paragraph (2) of this article.

Article 18 If key pollutant-discharging units and third-party operation and maintenance units tamper with, forge automatic monitoring data or interfere with automatic monitoring facilities, and are suspected of constituting a crime, they shall be punished in accordance with the Supreme People's Court and the Supreme People's Procuratorate's "On Handling Environmental Pollution" Interpretation of Several Issues concerning the Applicable Law in Criminal Cases" (Fa Interpretation [2016] No. 29) shall be punished in accordance with Article 10. According to Article 10 of No. 29), "the crime shall be transferred to judicial organs for investigation of criminal responsibility in accordance with the provisions of Article 286 or Article 338 of the Criminal Law of the People's Republic of China."

Article 19: For key pollutant-discharging units that have falsified automatic monitoring data, the ecological environment department shall promptly notify the relevant departments and cancel the environmental protection electricity prices, tax exemptions and other related preferential policies they enjoy in accordance with relevant regulations.

Article 20 After the promulgation of these Measures, if the Ministry of Ecology and Environment or the Provincial Department of Ecology and Environment has new regulations on automatic monitoring and management, and if there are special regulations on automatic monitoring and management of relevant industries, those regulations shall prevail.

Article 21 Article 3 If pollutant discharge units outside the scope of the provisions of these Measures take the initiative to install automatic monitoring equipment and network with the monitoring equipment of the ecological environment department, they shall be managed according to these Measures.

Article 22 These Measures shall come into effect on the date of promulgation.
