Traffic accident compensation, what if the statute of limitations has expired?

The first paragraph of Article 4 of the Supreme People's Court's Provisions on Several Issues Concerning the Application of the Limitation System in the Trial of Civil Cases stipulates that if a party fails to raise a defense of limitation during the first instance, the people's court will not support it during the second instance, except that it can prove that the claim of the other party has passed the limitation according to new evidence.
