How to write the application for adjournment of court session?

The application for postponement of the hearing is written as follows:

1, indicating the basic information of the applicant;

2. Indicate the application matters;

3. State the facts and reasons for postponing the trial;

4. State the name of the people's court;

5, the applicant's signature and seal, indicating the application time.

Under normal circumstances, in any of the following circumstances, it may be decided to postpone the trial:

1. If the party who should appear in court is unable to appear in court due to serious illness, a diagnosis certificate issued by the hospital shall be submitted;

2. If the parties who should appear in court cannot appear in court on the day of trial due to special tasks, special tasks generally refer to criminal investigation tasks performed by public security organs or police tasks performed by the army. Other reasons do not belong to the special task in this item, and the unit certification documents shall be provided;

3. If the parties who should appear in court have conflicts because the court hearing time has been fixed before the notice of hearing in this case is served, they shall provide subpoenas or notices of appearance issued by other people's courts;

4. If the party who should appear in court is unable to appear in court for other special reasons, including the person who needs to be raised suffering from serious illness or landslide on the way to the court, it shall issue a certificate issued by the relevant department.

Article 149

In any of the following circumstances, the hearing may be postponed:

(a) the parties who must appear in court and other participants in the proceedings have justified reasons for not appearing in court;

(2) The party concerned temporarily applies for withdrawal;

(3) It is necessary to notify new witnesses to appear in court, obtain new evidence, re-authenticate, conduct an inquest or make supplementary investigations;

(4) Other circumstances that should be postponed.
