What materials do I need to complain to the Lawyers Association?

I. Scope of acceptance

The scope of complaints accepted by this association is that members of this association have the following factual acts in the process of practicing or exercising their duties as lawyers:

(1) Violates the Lawyers Law, Measures for Punishment of Illegal Acts of Lawyers and Law Firms and other laws and regulations of the lawyer industry and judicial administrative regulations;

(2) Violating the Rules for Punishment of Violations of Bar Association Members (for Trial Implementation), the Code of Practice for Lawyers and other management regulations of the Bar Association.

Two. Scope of inadmissibility

The complaint of the parties is to reflect to us that members are suspected of violating the Lawyers Law or the industry regulations of the Bar Association in the course of practicing, and require us to deal with them according to the industry regulations, but the following situations are not within the scope of complaint acceptance of the Association according to law:

(1) Civil disputes such as contract performance, creditor's rights and debts, marriage and family, tort compensation, etc. between the parties and members of our association in daily life.

(2) The parties find that our members are suspected of personal injury, obstructing testimony and other acts that violate the criminal law.

According to national laws, the above two kinds of matters should be investigated, tried and judged by judicial organs and institutions such as people's courts, people's procuratorates, public security organs and arbitration committees. , is not within the scope of our complaint handling. You should submit them to the competent authorities for legal solution in time.

Third, matters needing attention

1. If a complaint is only made against the fees charged by a law firm, and the jurisdiction of the agreement dispute has been clearly stipulated in the principal-agent agreement between the complainant and the respondent, this Association will generally not accept it.

2. The relevant complaint materials submitted by the complainant to this Association shall be kept by this Association and will not be returned to the complainant.

3. Your complaint behavior is protected and restrained by national laws, so please exercise your rights according to law. If improper exercise of rights interferes with and affects the normal work of this Association, it may bear corresponding legal responsibilities.

Four, complaints need to submit materials:

(1) The materials submitted by the complainant in his personal capacity (the paper size is A4, and the binding space is reserved on the left side)

1. Complaint (in duplicate, printed on A4 paper and signed by the complainant, otherwise it will be invalid). The contents of the complaint are as follows: (1) Complainant's name, gender, work unit, contact telephone number, mailing address and postal code; (2) the lawyers and law firms complained about; (3) Complaint requests and requirements; (four) the facts and reasons for the complaint;

2. Agency agreement/contract signed by the complainant and the law firm (one copy);

(If it is a complaint from the other party or a third party, a separate explanation should be submitted to explain the reasons for the complaint. )

3, the law firm fee voucher (copy);

4. Copy of the complainant's ID card (one copy);

5. Certificates that the complainant can provide, evidential materials of the complaint, relevant awards and judgments (copy 1 copy);

6. Other materials that should be submitted.

(Note: Copies of the above submitted materials must be signed by the author and fingerprinted)

(2) If the complainant is a unit, the following materials shall be submitted:

1. Complaint letter (printed on A4 paper in duplicate, which must be stamped with the official seal of the company, otherwise it will be invalid). The contents of the complaint letter are as follows: (1) name of the complaint unit, mailing address and postal code, name of legal representative, telephone number and contact person; (2) the lawyers and law firms complained about; (3) Complaint requests and requirements; (four) the facts and reasons for the complaint.

2. Agency agreement/contract and power of attorney signed by the complainant and the law firm (one copy);

(If it is a complaint from the other party or a third party, a separate explanation should be submitted to explain the reasons for the complaint. )

3, the law firm fee voucher (copy);

4. Copy of the business license of the unit (one copy);

5. A copy of the power of attorney of the legal representative and the ID card of the trustee (one copy);

6. Copy of the ID card of the legal representative (one copy);

7. Certificates that the complainant can provide, evidential materials of the complaint, relevant awards and judgments (copy 1 copy);

8. Other materials that should be submitted.
