Extended information:
On February 25, 2011, the 19th meeting of the Standing Committee of the Eleventh National People’s Congress voted to adopt the Criminal Law Amendment (VIII)
Criminal Law Amendment (VIII)
passed.
The relevant provisions of the Criminal Law have been modified and added, and for the first time drunk driving, a behavior that seriously endangers social and public interests, is defined as a crime, and will be officially implemented on May 1.
The specific provisions are: "Whoever drives a motor vehicle to chase and race on the road, if the circumstances are serious, or drives a motor vehicle drunk on the road, shall be detained and fined."
Drunk driving means that the alcohol content in every 100 ml of blood is higher than or equal to 80 mg (inclusive of 80 mg).
This also means that in the future, those who drive a motor vehicle while drunk on the road will face a detention penalty of up to six months if caught.
The nature of illegal acts has also changed from administrative violations to criminal offenses.
Drunken driving by a civil servant is almost equivalent to destroying his "iron rice bowl." Paragraph 2 of Article 17 of the Regulations on Punishment of Civil Servants of Administrative Agencies stipulates that civil servants of administrative agencies who are sentenced to a criminal penalty in accordance with the law shall be dismissed.
