If local governments and departments have doubts about the nature of accidents, they shall refer to the relevant provisions of the Regulations on the Reporting, Investigation and Handling of Production Safety Accidents and identify them according to the following procedures:
1. An accident in which three people are killed at a time, or seriously injured 10, or the direct economic loss100000 yuan, shall be preliminarily identified by the people's government at the county level and reported to the municipal people's government with districts for confirmation.
2. Accidents that cause serious injuries to more than 3 people 10 people or more than 50 people 10 people, or direct economic losses of more than 50 million yuan 10 million yuan, shall be preliminarily identified by the municipal people's government divided into districts and confirmed by the provincial people's government.
3。 Accidents that cause more than 30 deaths 10 and less than 30 people, or more than 50 serious injuries and less than 100 people, or direct economic losses of more than 50 million yuan and less than10 million yuan shall be preliminarily identified by the provincial people's government and reported to the State Administration of Work Safety for confirmation.
4. Accidents that cause more than 30 deaths, or 100 people are seriously injured, or direct economic losses of 100 billion yuan or more are preliminarily identified by state administration of work safety and reported to the State Council for confirmation.
5. Accidents that have been put on file for investigation by public security organs should be reported as production safety accidents. If it is found to be a criminal case or a public security management case after the investigation, it shall be treated as a public security incident with the closing certificate issued by the public security organ.
Provisions on the investigation of administrative responsibility for extraordinarily serious safety accidents
Article 14 If the people's governments of cities (prefectures) and counties (cities, districts) fail to perform their duties in accordance with the provisions, or fail to perform their duties and procedures in accordance with the provisions, which leads to serious safety accidents in their own areas, they shall be given administrative sanctions of demotion or dismissal according to the seriousness of the circumstances; If it constitutes a crime of dereliction of duty, criminal responsibility shall be investigated according to law.
If the government departments and institutions responsible for administrative examination and approval and the relevant government departments responsible for safety supervision and management fail to perform their duties in accordance with these Provisions and a major safety accident occurs, the principal responsible persons of the departments and institutions shall be given administrative sanctions of dismissal or dismissal from public office according to the seriousness of the case; If it constitutes a crime of dereliction of duty or other crimes, criminal responsibility shall be investigated according to law.
Fifteenth in the event of a particularly bad social impact or a particularly serious safety accident, the State Council will give administrative sanctions to the governor, the chairman of the autonomous region, the mayor of the municipality directly under the Central Government and the principal responsible persons of relevant departments in the State Council.
Article 16 After an extraordinarily serious safety accident occurs, the people's governments of counties (cities, districts), cities (prefectures), provinces, autonomous regions and municipalities directly under the Central Government and the relevant government departments shall immediately report it according to the procedures and time limits prescribed by the state, and shall not conceal, falsely report or delay the report, and shall cooperate and assist the accident investigation, and shall not hinder or interfere with the accident investigation in any way.
After the occurrence of a serious safety accident, if the relevant local people's government and relevant government departments violate the provisions of the preceding paragraph, the main leaders of the government and the main responsible persons of the government departments shall be given administrative sanctions of demotion.
