Article 173 of China's criminal law stipulates: "The defendant in a private prosecution case may file a counterclaim against the private prosecutor during the proceedings. Counterclaim applies to private prosecution. " After accepting the entrustment of the defendant, the defense lawyer in a private prosecution case shall inform the defendant of the right to file a counterclaim against the private prosecutor. If the defendant asks the defense lawyer to assist him in filing a counterclaim, the defense lawyer meets the counterclaim after examination.
