Their work experience has taught me a lot of things that I didn't know before. Some judges worked hard and patiently answered our questions. For example, going to the price appraisal center with the judge is a criminal case, so I think things like price appraisal should be done by the public security bureau or the procuratorate, and the judge told me that the court did the price appraisal because the defendant asked for a re-appraisal, which I haven't learned in the textbook, or it's hard to think out of thin air without encountering practical problems.
We started with the most trivial thing, filling out various forms, but in the process of completing these tasks, I completely changed my previous view that it was useless to do odd jobs. As long as you put your heart into it, you will learn a lot from it. For example, in the process of sorting out the case file, we will find that a case file is the whole process of a case from occurrence to closure, and the criminal is sent to prison. The flow chart of case trial reflects the basic information of the case, from case acceptance, case division to case closure, all of which are classified into electronic information files. The procuratorate will submit the indictment and related materials to the court. In the criminal investigation of various cases by public security organs, a case is not a few simple physical evidence or confessions, but a very detailed and complete chain of evidence, which can truly prove the whole story of the case from the defendant's confession, the victim's statement, the witness's testimony, personal injury appraisal, price appraisal, inspection records, work records and appraisal records, to the telephone list and various physical evidence pictures. A lawyer's power of attorney, defense, civil materials and conciliation statement are not involved in every case, but they are also an integral part of criminal cases. It is the work of the court to register and record the case. Announcing a court session, making a trial transcript, announcing sentencing, writing a judgment, receiving a judgment, executing the judgment, obtaining a certificate and presenting a ticket are actually the final procedures of a criminal case from the public security bureau to the procuratorate and then to the court. About internship work
After two years of study in law, most of them are theoretical knowledge, and finally I have a chance to test my learning results with a real knife and a real gun. Unlike before, I just watched legal programs, attended lectures and watched mock trials. This internship in the court is true, and the real purpose of entering the judicial organs is to keep up with people's work rhythm and conduct actual combat drills at work and after work. After the internship, I feel very rewarding. In practical work, I have deepened my understanding of the work processes of various departments of the judicial system, enhanced my practical ability, especially the writing of judicial documents, further promoted the transformation of theoretical knowledge into practical work ability, and learned a lot of knowledge that is not available in textbooks.
Internship in a criminal court, the main internship subjects are criminal procedure law and criminal law, and occasionally some other private law subjects may be involved. In criminal courts, daily life is mainly about hearing, writing judgments, writing trial reports and taking notes. Cycle after cycle, day after day. But when you have enough patience to sit still and calm down, you will find the internship life in court very interesting! When I first came to the court as an intern, we interns were almost blank in terms of work experience. We need to start with a painting and observe other people's work bit by bit. We need to do seemingly insignificant things, take the initiative to fetch water, sweep the floor and clean the table, and actively integrate into office life. Many students complained that most of them were sent by people from the court and often had to run errands for others. But I think, after we enter the society, who will not be sent from the beginning? As for running errands, I think it is very understandable that everyone should start from the grassroots! As long as you work hard and actively at the grassroots level, you can learn a lot of unexpected things, including the implementation of some theories, including feeling the atmosphere of work, and the way to deal with people in small groups.
First of all, what I did in court was to read and organize the files. By reading the file, I can roughly grasp the handling process of a case. The more I read, the more detailed I have. At first, I felt a little boring and boring. Later, I gradually realized that it is very important to consult and organize the case files, which is the key to understanding the details of each case and the best opportunity to contact all kinds of cases. When I carefully consulted and sorted out a file that condensed the court's work flow, I gradually learned about the specific work of the court and the judge's handling ideas.
Secondly, many internships in criminal courts are the production and writing of legal documents, including judgments, trial transcripts, trial outlines, collegiate bench transcripts, etc. , and sometimes help the clerk to fill in some closing registration forms, enforcement notices, and remand tickets. There is no doubt that the production of these legal documents has a relatively modular framework, but the content needs to be constructed according to the plot of each case, which requires us to grasp every detail very carefully and cautiously. There are many things to pay attention to when drafting a judgment, such as 1. Different procedures are adopted, and the writing of the judgment is also different. Some parts of the simple program can be abbreviated, but many parts of the ordinary program need to be written in detail; 2. The place where the defendant is detained is different for male prisoners and female prisoners, and it is also necessary to indicate those who have been released on bail pending trial and those who have not been detained. In the process of writing legal documents, I learned a lot of knowledge and understood many theoretical problems. The longest cause of a case may be only a dozen words, but we can't ignore these words. When making a judgment, it is very important to determine the nature of the case, because it directly affects the sentencing of the suspect (defendant). If a person's behavior does not constitute a crime, it is undoubtedly a great mistake, and sometimes even unforgivable; Even if there is conclusive evidence to prove that a person has committed a crime, it should be accurately characterized. We can't let criminals get away with it, but we can't ignore the right that criminal suspects (defendants) should be treated fairly, fairly and reasonably, be responsible for their own work and then be responsible for others. This is also an important manifestation of our respect for human rights.
Thirdly, the biggest convenience of internship in the court is that you can often attend the trial. In the trial of criminal cases, solemn courts, sacred atmosphere, strict procedures and fierce debates can at least make people feel that procedural justice is a vivid embodiment here. In the process of auditing, the ability of judges and prosecutors to control the whole case, clear thinking and rigorous logical language really made me envy and marvel. Although I have studied law for two years, I really feel that our only professional knowledge is far from enough during the audit. While strengthening theoretical cultivation, we need to accumulate practical experience and social experience in handling cases.
