In the lawyer's view, the problem of Zhai case lies in legislation.

Tracing back to the legislative evolution of the crime of producing and selling counterfeit drugs, he found that counterfeit drugs were defined in the Criminal Law of 1997 according to the provisions of the Drug Administration Law, and the counterfeit drugs stipulated in the then effective Drug Administration Law did not include genuine drugs imported without approval or inspection.
