The judge’s legal liability for miscarriage of justice

If a judge commits any of the following acts, he shall be punished; if it constitutes a crime, he shall be held criminally responsible in accordance with the law:

(1) Corruption, bribery, malpractice for personal gain, or miscarriage of justice;

(2) Concealing, forging, altering or deliberately destroying evidence and case materials;

(3) Leaking state secrets, trial work secrets, business secrets or personal privacy;

(4) Intentionally violating laws and regulations when handling cases;

(5) Making wrong judgment results due to gross negligence, causing serious consequences;

(6) Delaying case handling, delaying work;

(7) Taking advantage of one’s authority to seek personal gain for oneself or others;

(8) Accepting benefits from the parties and their agents, or meeting the parties and their agents in violation of relevant regulations. Or violate relevant regulations to meet with the parties and their agents;

(9) Violate relevant regulations to engage in or participate in for-profit activities, and hold concurrent positions in enterprises or other for-profit organizations;

(10) Other disciplinary and illegal acts.

Disciplinary sanctions against judges shall be carried out in accordance with relevant regulations.

Judges who violate discipline will be dealt with in accordance with relevant regulations.
