Public security, safety supervision, quality supervision, industry and commerce departments shall, in accordance with their statutory duties, organize the investigation and punishment of illegal production, operation, storage, transportation, mailing and illegal discharge of fireworks and firecrackers.
Environmental protection, urban management, city appearance and sanitation, supply and marketing, sub-district offices, residents' committees and villagers' committees shall, in accordance with their statutory duties, assist relevant functional departments in their implementation. Article 3 Fireworks and firecrackers are prohibited in the administrative areas of xiaodian district, yingze district, Xinghualing District, jiancaoping district, Wanbailin District and Jinyuan District of this Municipality.
The scope of prohibiting or restricting the discharge of fireworks and firecrackers in administrative areas outside the scope specified in the preceding paragraph shall be stipulated by the local people's government at the county level. Article 4 No unit or individual may retail fireworks and firecrackers in areas where fireworks and firecrackers are prohibited (hereinafter referred to as prohibited areas).
Units that produce and operate wholesale fireworks and firecrackers shall not sell fireworks and firecrackers wholesale in the forbidden area. Fifth without the approval of the public security organs at the county level in this Municipality, no unit or individual may transport fireworks into the forbidden area. Sixth in violation of the provisions of any of the following acts, shall be punished by the public security organs:
(1) Units that discharge fireworks or engage in large-scale fireworks and firecrackers discharge activities shall be ordered to stop the discharge, and a fine of not less than 1 10,000 yuan but not more than 50,000 yuan shall be imposed, and the persons who are directly responsible and the approvers shall be fined not less than 1500 yuan respectively;
(two) individual fireworks, shall be ordered to stop the discharge, and impose a fine of more than 200 yuan and less than 500 yuan.
Those who violate the administration of public security shall be punished according to law. Seventh in violation of the provisions of article third, four, five, resulting in economic losses or personal injury, shall be liable for compensation; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 8 If a person without capacity violates these regulations and a person with limited capacity violates these regulations and has no economic income, his guardian shall be liable for damages. Ninth during the Spring Festival, fireworks can be set off in the forbidden area, which shall be announced by the Taiyuan Municipal People's Government.
If it is necessary to set off fireworks and firecrackers at major national events and festivals, the Taiyuan Municipal People's Government will issue an announcement.
The announcement shall specify the specific time, place and variety of discharge. Tenth in violation of the provisions of the discharge, sale and import of fireworks, units and citizens can discourage and report; The people's government shall commend or reward those who report meritorious service. Eleventh the problems in the specific application of these Provisions shall be interpreted by the Taiyuan Municipal People's Government.
