Can close relatives accept entrustment as lawyers?

Close relatives may be entrusted as lawyers.

An agent. The entrusted agent may be a citizen or a legal person; When the entrusted agent is a citizen, he must have the corresponding capacity for civil rights. When the entrusted agent is a legal person, the entrusted matters must conform to its business purpose and business scope. The entrusted agent may be one person or more than two persons. The former is called "single agent" or "one-person agent", and the latter is called "* * * same agent". In the case of * * * agency, the power of attorney shall specify the agency authority of each entrusted agent to prevent mutual shirking and clarify the responsibilities in case of disputes. If the power of attorney does not specify the agency authority of each entrusted agent, it is presumed that the agency rights and responsibilities of each entrusted agent are equal.

The entrusted agent has the right to refuse the entrustment at any time, but it shall promptly notify the principal, that is, the principal and the relevant parties, otherwise the losses caused thereby shall be borne by the entrusted agent. The entrusted agent shall exercise the agency right correctly and reasonably, and shall not abuse the agency right to harm the interests of the principal. The entrusted agent has the right to express his will independently within the scope of agency authority. The entrusted agent shall personally complete the entrusted matters, and shall not delegate them without authorization except in case of emergency.

Principal-agent is an agency system that provides litigation convenience for the parties and safeguards their legitimate rights and interests. In real life, some parties are difficult to litigate in person for some reasons, or need help from others in litigation due to lack of legal knowledge and litigation experience, which requires entrusting others to represent them. The parties can fully exercise their litigation rights, fulfill their litigation obligations and better safeguard their legitimate rights and interests by entrusting agents to conduct litigation.

According to Article 33 of the Criminal Procedure Law of People's Republic of China (PRC), the defendant in a private prosecution case has the right to entrust a defender at any time. The people's court shall, within 3 days from the date of accepting the case of private prosecution, inform the defendant that he has the right to entrust a defender.
