Turtle basalt

Turtles had a high status in ancient times and were regarded as spiritual beasts, that is, Xuanwu. Xuanwu is a spiritual thing composed of turtles and snakes. Xuanwu originally meant Xuanming, and the ancient sounds of Wu and Ming are interlinked. Xuan means black; Ghost means yin. At first, Xuan Ming described the tortoise's divination as follows: the tortoise's back is black, and the tortoise's divination is to invite the tortoise to the underworld to ask questions, bring back the answers and show them to the world in the form of divination. So the prototype of Xuanwu is the tortoise. Unexpectedly, although the tortoise was beautiful all the way, unfortunately, it was slowly made into rumors, and it was the book Shuowen that collected rumors. Xu Shen (about 58- 147), the author of Shuowen, was born in Yancheng, Henan. He was an ancient writer in Han Dynasty, famous for his extensive reading, and everyone was convinced that he was "unparalleled in the Five Classics". Xu Shen completed a book Shuo Wen around 100. This book was originally a book about fighting pens, which was used to refute the saying that today's writers interpret classics. Unexpectedly, the arrangement of Chinese characters in the book shows another meaning. Since then, it has become the first dictionary compiled by radicals in China. Shuowen consists of 540 radicals and 9353 words. It has determined the form of Chinese dictionaries for two thousand years, and has also made the most influential contribution in philology and semantics. The focus of Xu Shen's book is to explain why a word should be written like this. He wants to find out the original meaning of each word, and then explain why he wrote it according to the original meaning. In this way, this book contains many figures from Xiao Zhuan and the late Zhou Dynasty, which enables us to trace back to the source and solve many problems in entering the classics. (Shuowen is Shuowen Jiezi, and its true value was not recognized until the Qing Dynasty. )

Under the note "turtle" in Shuowen, there is such an authoritative explanation:

Turtle, old also. Those who have flesh outside the bones are also. From it (snake). The glans penis is the same as its (snake head). The nature of heaven and earth, broad shoulders without male, turtles, take it (snake) as male.

That is to say, there is no male turtle (Liezi said it is a "pure mother"), and if you want to have a baby turtle, you have to mate with a snake. Because of this, the "glans penis" and "snakehead" look the same. "Ya Ya" said: "There is no male with broad shoulders, and the snake is a horse, so the tortoise and the snake are combined, which is called Xuanwu." Xuanwu refers to the tortoise and snake, and later became the "God of the North", ranking second only to the Jade Emperor. The forty-eighth issue of Folk Custom contains Chaozhou Children's Songs, the original text of which is: "The basin is covered with water (covered with water, but also stored with water), which is clear and complete. I saw Grandpa Bei (God is also mysterious) in the back seat, riding (riding, holding) a sword, with a shawl on his head and a turtle and snake under his feet. " This is the personification of Xuanwu. There is an article "Yao Zun talks about the Northern Wuqi Classics in Yuan Dynasty" written by the orthodox Daojing Cave Ministry, which clearly shows that this anthropomorphic style is to throw your hair on your feet and step on the tortoise and snake, indicating the tortoise and snake family, which has long been recognized by China people.

Unfortunately, the ecology of China people is not very good. Since ancient times, people in China have not clearly observed turtles. China people think that the tortoise is "ungodly", which is completely wrong. This mistake is recorded in Shuowen, so the turtle can't hand it in. While others make friends with snakes. Since belonging to the family does not engage in belonging to the family, belonging to the family actually raped the snake outside, then what is there to say about being "no man" on the one hand? "In the Yuan Dynasty, there was a" Yuan Law "system, saying that prostitutes wore purple soap shirts and horns. The parents and relatives of prostitutes wear green headscarves. The blue headscarf is similar to green. The headscarf in Ming Dynasty was green, and green was like the glans. Therefore, all affiliated associations are slowly gathering. According to the "green headscarf" in "Jade Cong Kao":

In the Ming Dynasty, musicians wore green heads, and Wu people took their wives as prostitutes. It's called the green headscarf. See "Seven Revisions" for details. The intimate record also states that the actor wears green clothes, the ladies wear silk, the prostitutes don't, and the actress's wife doesn't wear a crown or a scorpion. However, the actors are not only wrapped in green towels, but also dressed in green clothes. According to the records of Hehe, Li was named Yanling Order. If an official is guilty, he will not be given a stick, but he will be ashamed of being wrapped in green, and the number of days will be given according to his crime. Wu people are ashamed of this suit. The order of the Ming dynasty made people wrap green towels, or that's all.

In the Ming Dynasty, Lang Ying said under the article "Green Scarf" in the Seventh Revision: "But why did Li Feng use a green scarf at that time? And when I saw the wives and daughters who had beggars in the Spring and Autumn Period, I called them' prostitutes' and wrapped their heads in green towels to make them different. And know that you will never be far away. Li Feng also because it is a shame. Today, it is more profound than music. " In the Tang Dynasty, Li Feng was punished for cheating people by wearing a green headscarf. At that time, the green headscarf was mainly a symbol of shrew's clothes, but it was not finally defined as "taking care of us" and sleeping with others. Later, the tortoise and snake said that the color of the glans, the green headscarf, the prostitute's house, and so on, all the parties gathered together, so wearing a green scarf instead of a green scarf is green! (The cuckold is used after the Qing Dynasty. The most famous sentence in Wang Zhichun Fu written by Master Yi is "The hat turns green and the top flies red". According to the "five miscellaneous" theory, the turtle is "the mistake of dirty boudoir", which was changed by raping the eldest daughter; Turtle is the change of "forgetting eight", "forgetting eight because of its filial piety, brother, loyalty, faith, courtesy, righteousness, honesty and shame" These statements are untenable. This explanation of the evolution of turtles is obviously irrelevant to facts and truth, so it is undoubtedly incidental.

For China people, their fear, disgust and unwillingness to the tortoise are unique. This fear, disgust and unwillingness have been spread to a bizarre degree (in this respect, it seems that only Italians are somewhat magical). Legally speaking, his wife committed adultery, while the "adulterer and adulterer" only committed adultery without trial and prosecution. However, some people, out of fear, disgust and unwillingness, sued for libel because they thought he had become a tortoise. In fact, the judges of the High Court made arbitrary judgments. As long as you look at a reason why a judge of the Supreme Court of Taiwan Province Province rejected it, you can learn from it:

Supreme Court 1963 Civil JudgmentNo. 1068

The appellant Zheng Zujin lives at No.2 Chenggong Road, Zuo Ying, Kaohsiung City.

The appellee Mao Wei Li lives at No.23, Zhongshan Road, Tongyou.

In the event that both parties claimed damages, the appellant filed a lawsuit against the second-instance judgment of Tainan Branch of Taiwan Province Provincial High Court on 1962 10/6. Our judgment is as follows:

The main part of the court's decision

The original judgment ordered the appellant to compensate and give up part of the litigation costs, and sent it back to Tainan Branch of Taiwan Province Provincial High Court.

reason

In this case, the appellee sued the appellee for compensation because the appellee seduced his wife Mao Chenchunzi, was convicted by the court, and made a scene in Haixun Daily, which caused great damage to the appellee's reputation and spirit. According to Article 195 of the General Principles of the Civil Law, the appellee shall be liable for compensation, which is the cause of the lawsuit (see Annex for the civil complaint attached to the criminal case). Criminal judgment's investigation was based on the crime of adultery in the second half of Article 239 of the Criminal Law, and the appellant was sentenced to a combined punishment for one crime. It does not contain any information about how the appellant violated the appellee's reputation. Reputation right is one of personality rights, but the personality of husband and wife is different, and the wife commits adultery with others. It cannot be said that the adulterer infringes on the husband's reputation right. According to the original judgment, on July 30th, 196 1, the news of the appellant's adultery with Mao Chenchun was written by Wenbo, a journalist who lives with the appellant. It was not the appellant who published the news, but the appellant did not make big news in Haixun Daily, which caused the appellee's reputation and mental damage. The trial judge ordered the appellant to pay NT$ 4,000 for having an affair with the appellee's wife, which was reported in the newspapers. However, this appeal should be considered reasonable.

According to the above conclusions, this appeal is justified. According to the provisions of the first paragraph of Article 474 and the first paragraph of Article 475 of the Civil Procedure Law, the judgment is as follows.

1April 963 13

The judge of the Supreme Court obviously thinks that treating a person as a turtle is not an infringement of "reputation right", because reputation right is a kind of personality right, and the personality of husband and wife belongs to each other. "When a wife commits adultery, it cannot be said that the adulterer has violated her husband's reputation." This case shows that law is more progressive than social concept, but it is also quite interesting.

Based on the above discussion, we can clearly see that the tortoise has gone from bad to worse in all aspects. Finally, legally, even when he becomes a turtle, that's all. This is really a great memory of the ancients. Because in ancient times, not only turtles were protected by law, but even turtles were beaten. Although the Tang Law sentenced the "adulterer and adulterer" to two years (redemption of 40 Jin of copper), compared with today's "fixed-term imprisonment of less than one year", it was not a case of surrender, nor was it a crime without prosecution, but a crime that the neighborhood could report. According to the laws of the Yuan Dynasty, failure to report is "vertical rape" and even neighbors will be punished. As for those who are willing to be turtles, it is even worse. The Yuan Dynasty was clearly defined as a tortoise, Fu Cha adulterers each had 87 sticks, and Ming and Qing Dynasties each had 90 sticks. It can be seen that every turtle will be severely beaten. Now the tortoise is the tortoise, at least don't be beaten again. This progress is the result of the tortoise's plummeting. At this point, I can't help laughing that the Kuomintang also has good policies. At least when they "forget eight" and "look forward to eight", they stop hitting turtles!
