Defendant Shan Haoran, male, born in 1973** Born on **, ID number: 3213241973 ********, Han nationality, high school education, self-employed, lives at No. ** Street, ** Town, Sihong County. The defendant Shan Haoran was criminally detained by the Sihong County Public Security Bureau on September 5, 2016, on suspicion of fraud. He was arrested with the approval of this court on September 15, 2016, and was arrested by the Sihong County Public Security Bureau on the same day.
This case was investigated by the Sihong County Public Security Bureau, and the defendant Shan Haoran was suspected of fraud and filed a review and prosecution with this court on September 21, 2016. After accepting the case, the court informed the defendant Shan Haoran on the next day that he had the right to appoint a defender, and informed the victim Tian Moumou and others that they had the right to appoint a litigation agent. It interrogated the defendant Shan Haoran in accordance with the law and listened to the statements of the victim Tian Moumou and others. , reviewed all case materials.
Filing a case for investigation in accordance with the law:
In October 2015, three ships purchased by the victims Tian, ??Pan A, Pan B and others failed to pass the middle route of the South-to-North Water Diversion Project due to incomplete procedures. At the sluice gate of Zhuhu Station in Hong County, Hou Tian sought help from defendant Shan Haoran through Pan Moucheng. Defendant Shan Haoran deceived Tian, ??Pan, Pan Mouyi and others had a relationship with the defendant Shan Haoran. Tian, ??Pan A, Pan B and others totaled 116,000 yuan, and used the defrauded money to repay debts and personal consumption.
It was also found that the defendant Shan Haoran truthfully confessed his crime after being brought to justice.
The evidence for determining the above facts includes:
1. Household registration information, bank card transaction records and other documentary evidence obtained by the Sihong County Public Security Bureau;
2. Testimonies of witnesses Liu Moumou, Pan Moucheng, Zhu Moumou and others;
3. Statements of victims Pan Mouding, Tian Moumou and others;
4. Defendant Shan Haoran’s confession and defense.
This court believes that the defendant Shan Haoran used fictitious facts and concealed the truth for the purpose of illegal possession to defraud others of huge amounts of property. His behavior violated the "Criminal Law of the People's Republic of China****" 》Article 266: If the criminal facts are clear and the evidence is reliable and sufficient, the criminal liability shall be investigated for the crime of fraud. If the defendant Shan Haoran truthfully confesses his crime after being brought to justice, he may be given a lighter punishment in accordance with the provisions of Article 67, paragraph 3, of the Criminal Law of the People's Republic of China. In accordance with the provisions of Article 172 of the "Criminal Procedure Law of the People's Republic of China", a public prosecution is filed and the person shall be sentenced in accordance with the law.
