ICBC gave a clear answer: it will definitely compensate. Snow tires are not required for driving on Vancouver's urban highways. Failure to replace snow tires does not mean that the driver automatically assumes driving negligence.
Criminal lawyer Kyla Lee said that ICBC will consider two points when evaluating insurance claims: first, whether the driver has valid insurance; second, whether the driver has certain Violations that invalidate coverage, such as an expired or suspended driver's license.
If these issues do not exist, we can discuss compensation with ICBC. After an accident occurs, the driver can take photos to collect evidence and call ICBC's Chinese hotline 1-855-813 2121 to report the accident. Afterwards, ICBC will assign a specialist to handle the claims and treat the injured.
After filing a claim, the driver will receive a claim number, with which he can go to a local designated physiotherapy hospital to receive free physiotherapy.
