(a) the parties who must appear in court and other participants in the proceedings have justified reasons for not appearing in court;
(2) The party concerned temporarily applies for withdrawal;
(3) It is necessary to notify new witnesses to appear in court, obtain new evidence, re-authenticate, conduct an inquest or make supplementary investigations;
(4) Other circumstances that should be postponed.
If you need time to verify something, you can apply for an extension of the hearing on the grounds of point (3). What needs to be done is to write an application for adjournment and submit it to the civil court judge in charge of hearing the case, who will decide whether to postpone the trial.
Extended data:
Postponement of the trial can only occur at the trial stage, and the litigation acts that have been implemented before the postponement of the trial are still valid for the postponement of the trial. However, the extended time is not counted in the probation period.
The Civil Procedure Law and other relevant legal interpretations do not clearly stipulate the number of times to apply for an extension, nor how long to extend it, but the Civil Procedure Law stipulates the trial period, that is, a case tried by the people's court through ordinary procedures shall be concluded within six months from the date of filing the case. If there are special circumstances that need to be extended, it can be extended for six months with the approval of the president of our hospital; If an extension is needed, it shall be reported to the people's court at a higher level for approval.
According to the Supreme People's Court's judicial interpretation, the trial period stipulated in Article 135 of the Civil Procedure Law refers to the period from the date of filing the case to the date when the judgment is pronounced and the conciliation statement is served, but the period of declaring, appraising and hearing the jurisdictional objections raised by the parties and the jurisdictional disputes between the people's courts is not counted. It can be seen that the number and time of applying for an extension of the trial are limited by the trial period, not unlimited.
