(1) divorce by agreement. If you and the prisoner both agree to divorce, and have reached an agreement on child support, property division and other matters and signed a divorce agreement, you can go to the marriage registration office where your household registration is located-Customs for divorce registration. However, due to the particularity of prisoners' identity, prisoners generally need to apply for divorce-management from the prison and be accompanied by the prison-education officer-police, or the prison coordinates the marriage registration office-admission-divorce-marriage registration.
(2) If the prisoner does not agree to divorce, or has different opinions on property and custody, he can divorce through litigation-divorce-marriage. Divorce-marriage litigation against prisoners is under the jurisdiction of the plaintiff's domicile-civil law-court. Where the plaintiff's domicile is inconsistent with his habitual residence, it shall be under the jurisdiction of the plaintiff's habitual residence-civil law-court. If the defendant is imprisoned or reeducated through labor for more than one year, he shall be under the jurisdiction of the person who is imprisoned or reeducated through labor.
