Traffic accidents can't afford medical expenses and can't afford compensation. Should I go to jail?

Traffic accidents are identified by the public security department. Only those who take full responsibility or major responsibility and cause heavy casualties will bear criminal responsibility. Positive compensation is only the basis for a lighter punishment. Therefore, they are only liable for civil compensation, even if they are unable to pay compensation, they can only suspend execution and will not go to jail.

Legal basis: 1, criminal responsibility. Article 133 of the Criminal Law refers to the crime of causing traffic accidents, causing serious injuries and deaths, or causing heavy losses to public and private property, and being investigated for criminal responsibility according to law. Whoever commits a traffic accident shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention. Whoever escapes after a traffic accident or has other particularly bad circumstances shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years. Whoever escapes and causes death shall be sentenced to fixed-term imprisonment of not less than seven years.

2. Civil liability. The traffic administrative department of the public security organ shall determine the responsibility of the parties according to the role played by their actions in road traffic accidents and the severity of their faults.

(a) due to the fault of one party caused by road traffic accidents, take full responsibility;

(2) If a road traffic accident occurs due to the fault of two or more parties, they shall bear primary responsibility, equal responsibility and secondary responsibility respectively according to the role their actions played in the accident and the severity of the fault;

(3) The parties are not at fault for causing road traffic accidents. If it is a traffic accident, neither party is responsible.

If one party intentionally causes a road traffic accident, the other party shall not bear any responsibility.

3. Article 256 of the Civil Procedure Law shall be suspended by the people's court under any of the following circumstances:

(1) The applicant indicates that the execution can be postponed;

(2) The outsider raises legitimate objections to the object of execution;

(3) A citizen who is a party dies and needs to wait for the successor to inherit the rights or assume the obligations;

(4) The legal person or other organization as a party terminates, and the successor of rights and obligations has not been determined;

(5) Other circumstances in which the people's court considers that execution should be suspended.

When the suspended situation disappears, execution will resume.
