Joo Won? was acquitted. What did Joo Won?'s mother say?

"After running around for 20 years, I can finally wash away the stigma of my husband and my son. But I lost my whole life. If you lose it, you will lose it forever and never come back. "

After he was released from prison, Joo Won? was arrested at the age of 27 and was 42 when he was released from prison. The picture comes from the internet.

This morning 1 1, the Xinjiang Higher People's Court again publicly pronounced the case of Joo Won?'s intentional injury and forced molestation of women. The court held that the evidence in the case was insufficient and Joo Won? was acquitted. Joo Won?, 47, was accused for nearly 20 years and was finally acquitted.

It is reported that Joo Won?, a 27-year-old youth from Yining City, Xinjiang, was taken away by the police at home on May 6, 1997. Since 199 1, violations against women have occurred frequently in Yining City. The suspect attacked the woman while she was sleeping and stabbed her lower body with a sharp weapon. The police failed to solve the case for many years, and the whole city was once in a panic. 1997 In the early morning of May 16, another similar case occurred. Joo Won? was arrested on August 7 of the same year and was identified as a suspect of intentional injury and hooliganism.

1On August 30th, 998, Joo Won? was sentenced to death with a suspended execution. Since then, the case has been retried many times, and its sentence has been changed from suspended death to life, and then to fixed-term imprisonment 15 years. 2012,21may, Joo Won? was released from prison.

2065438+July 2003 18, the Supreme Law instructed Xinjiang High Court to review the case. 201611kloc-0/8 The Supreme Court issued a retrial decision, instructing Xinjiang High Court to conduct a retrial.

In order to exonerate her son, Li Bizhen, who is over 70 years old, has been running around for more than 20 years, insisting on appealing for her son, and finally waited for the sentence to be changed. I talked to Joo Won? and his mother Li Bizhen this morning.

Dialogue: Li Bizhen, Joo Won?'s mother.

"I finally don't have to run around on the road."

How did you feel when the judge acquitted Joo Won??

Li Bizhen: I am unhappy. My life has been disrupted and it is impossible to recover. Others say that when this matter is over, I can live a normal life and live a good life in the future. If this didn't happen, my husband would still be here, and Joo Won?'s son and my grandson would go to college. It is impossible to go back. Thinking about these things will make you less happy than before.

The case has changed, and my old lady finally doesn't have to run around on the road. That's all.

Did you ever think you'd get this result?

Li Bizhen: Others say that the result of innocence is very sure. The Supreme People's Court's retrial decision No.20161kloc-0/8 also called "the evidence is not true and sufficient". But I still feel uncertain. Innocence is still in the mirror before sentencing.

This case has been retried many times. Why do you think it took so long to rehabilitate?

Li Bizhen: I didn't say you could imagine. Will I be willing to admit what I did wrong?

Do you think it's worthwhile to rehabilitate grievances for more than 20 years?

Li Bizhen: It's worth half. But do you think it's possible to finish the other half?

What does the other half mean?

Li Bizhen: Accountability.

165438+1On the morning of October 30th, Joo Won? was acquitted by Xinjiang High Court.

"I still want to go alone."

When did you first start to redress your grievances?

Li Bizhen: 1997 May 17 From the day my son was arrested. I have been on the way to appeal for years. Never thought about giving up.

What is supporting you?

Li Bizhen: I think my son has been wronged. I want to avenge him. You framed my son. You're a fake. It can't be fake, it can't be fake. Over the years, I have come to my husband's death, and I still have to go alone.

Over the years, every conceivable procuratorate, court and government department has been searched?

Li Bizhen: Yes. Someone told me before that I would kneel at the gate of the court and ask them to correct me. I said, they misjudged my son. Why should I kneel? If you want to kneel, kneel for me and my son. That's right. There is only one truth.

20111February, Xinjiang Higher People's Court retried the verdict and changed it to 15. The judge told the lawyer that it was meaningless to persuade me not to petition. I told my lawyer that my son didn't commit a crime, let alone 15 years, 15 days, or 15 minutes. I must avenge my son.

2012,21may, Joo Won? was released from prison. Will your son's freedom shake your determination to take revenge?

Li Bizhen: After he got out of prison, instead of relaxing, I felt heavier. My son is in prison. How is he, good or bad? I can't see. There is a word called "touching the scene", which I think is very appropriate. I think he has changed since he got out of prison. 15 years later, things have changed. His actions, his language and his communication with people are out of touch with the present, just like a man dug out of a grave. Why did my son become like this? !

"I can be my son's defender."

The case was sent back for retrial by Xinjiang High Court for the first time. Have you ever defended your son in court?

Li Bizhen: I just wanted to know how the case was going, but the case was not heard in public, so I couldn't attend. The lawyer said that as a guardian and relative of the defendant, he can go in as a defender. I went to the judge several times and refused. Until the night before the trial, before leaving work, I went to tell the judge that according to Article 32 of the Criminal Procedure Law, I am Joo Won?'s mother and I can be his defender. It's illegal not to let me in. The judge agreed.

The media reported that you only attended primary school for one and a half years. How did you argue in court?

Li Bizhen: I don't know the law. I am an uneducated woman. I said it according to common sense. For example, my son confessed that the murder weapon was a knife. I know that scissors cut things neatly, and it must be uneven if you use a knife to cut them. I asked the judge to take out the victim's pants and see if they were cut with a knife or scissors.

At that time, there was no other evidence except the confession. My son's case should be governed by 1997 and the criminal procedure law should be implemented. Article 46 of the Criminal Procedure Law stipulates that if only the defendant confesses and there is no other evidence, the defendant cannot be found guilty and punished; If there is no confession from the defendant and the evidence is sufficient and reliable, the defendant may be found guilty and punished. This is enough.

How did you learn all this legal knowledge?

Li Bizhen: Here and there. When my husband was still alive, I went out to avenge myself and came back to tell him who I met and what the other party said. Speaking of legal terms, he went to the book and told me what to say next time I met this problem, so I wrote it down. After my husband died in 2006, I didn't learn much.

I also watch TV and newspapers, such as focus interviews and legal reports. I once persuaded a judge with the opening remarks of a legal report, but I couldn't tell the facts clearly or the jurisprudence clearly.

Have you changed over the years?

Li Bizhen: Now I have developed a loud voice, even a little hysterical. In the past, everyone petitioned together, and you could say whatever you wanted. I also want to say that in order to grab time, I turned up my voice invisibly. Now when I speak, people tell me, Comrade, keep your voice down. Aunt, I heard it in the next room.

"What is lost is lost forever."

How to sum up your twenty years?

Li Bizhen: I recorded a program on TV on 20 15. The host said that the old lady lived for this thing 18 years. This is from someone else's mouth, and when I think about it, it is. I will live for this for the rest of my life. Nothing to eat, nothing to enjoy. Every day my son lives, I will live one day less. His life is based on me.

What have you gained in these years? What have you lost?

Li Bizhen: With justice, I can finally wash away the stigma of me, my husband and my son. But I lost my whole life. What is lost is lost forever, and it is impossible to come back.

How are you now?

Li Bizhen: I am old and in poor health. After all, he is over seventy years old.

What's the next plan?

Li Bizhen: I haven't decided yet. Think about which step to take. When the case is changed, the state compensation behind it will naturally come into being. I don't know how to arrange my future life.

Dialogue character: Joo Won?

Change the sentence

"This is not just my business."

How do you feel when you know you are innocent?

Joo Won?: Happy. Thanks to many people who have helped me. My classmates and some people I know and don't know in society. One or two words can't be finished.

I didn't expect my case to be corrected. Even before today's verdict, I was waiting for the verdict with a stable mood. My friend told me that no matter what the result is, I should keep a good attitude and not be overjoyed.

Do you think it's worthwhile for mom to travel for more than 20 years?

Joo Won?: Worth it. It seems that this is my own business, but it can't just be understood as my own business. I vindicate this matter, which is good for our whole country and society. At least similar things can happen less in the future. Everything in this country is developing in a good direction.

Have you ever appealed to yourself since you were free?

Joo Won?: I went to the procuratorate several times and expressed my thoughts. Later, my mother took charge of it. I have to earn money to eat.

Mom has been running for you for more than twenty years. What do you want to say to her?

Joo Won?: I think my mother is very capable and great. I also met many mothers who may be older than my mother in court, and they are also rushing for their children's cases. They're really great. They're great.

future

"Make more money and develop slowly"

What is life like now?

Joo Won?: Now I am mainly engaged in water heating and natural gas installation. It's cold, so I can't work. I started to rest almost five days ago.

Do you still think about life in prison?

Joo Won?: I forced myself not to think about things in prison and the process of handling cases. Sometimes I can't help thinking about it, as if the back of my head twitched. I told myself, I can't think, it's not good for my health. Just like when I was in prison, I told myself that I had to get out alive.

How does this affect you?

Joo Won?: Very big. I told my friends that by rights, I should have children now. But this thing that should have come didn't come. At work, I also think that without this thing, I wouldn't be doing this job, and I wouldn't be so hard as I am now, maybe working eight hours a day. Now, life and work are different.

What are your plans for the rest of your life?

Joo Won?: Try to earn more money. My friend's side is the grassland. When I am rich, I will raise a few cows and develop slowly. Sometimes I think, when I earn money, I don't know if my mother will have a chance ... She had an operation last year and is in good health now, but after all, she is old and I dare not think about the later things.

Finally, it gave a good result. I hope Joo Won? and his mother can live happily.
