What about the house frozen by the court?

Houses frozen by the court shall be handled in the following ways:

3. relieve spasm. If the property is seized due to arrears, the owner can repay the loan in time and then apply to the court for lifting the seizure. According to the "Provisions of the Supreme People's Court on the Attachment, Seizure and Freezing of Property in Civil Execution by People's Courts", in some cases, the court will lift the attachment, for example, the debt has been paid off and the person subjected to execution has provided a guarantee.

In addition, if the property is the only house in the family, it is usually not allowed to be enforced, but the court can still continue to seal it up. It should be noted that after the house is frozen, the owner cannot transfer the house, and normal transactions can only be carried out after the freezing is lifted. If the owner cannot repay the arrears, the bank may auction the property, and the proceeds from the auction will be used to repay the arrears.

Classification of courts:

1. Basic people's courts: including county people's courts, municipal people's courts, autonomous county people's courts and municipal people's courts. These courts try a large number of cases, accounting for about 95% of the first-instance cases in the country. The name of the basic people's court usually appears after the district name in the form of "people's court", such as "Wuhou District People's Court in Chengdu".

Higher People's Courts: Located in all provinces, autonomous regions and municipalities directly under the Central Government, they accept all kinds of cases of first instance and appeals of second instance, and hearing appeals of second instance is the main work of the Higher People's Courts. The name of a higher people's court usually adds "Higher People's Court" after the name of a province, such as "Sichuan Higher People's Court".

4. the Supreme People's Court: Located in Beijing, it is the highest judicial organ in People's Republic of China (PRC). Responsible for hearing all kinds of cases, formulating judicial interpretations, and supervising the trial work of local people's courts at all levels and special people's courts. The Supreme People's Court can set up a circuit court to hear cases determined by the Supreme People's Court according to law, and the judgments and rulings of the circuit court are those of the Supreme People's Court.

Article 16

If the person subjected to execution sells his property to a third party, and the third party has paid part of the price and actually occupies the property, but the person subjected to execution retains the ownership according to the contract, the people's court may seal it up, detain it or freeze it. If the third party requests to continue to perform the contract, it shall make an order to lift the seal-up, seizure and freezing after paying all the balance to the people's court within a reasonable period of time.
