Regulations of Nanjing Municipality on Public Security Work of Organs, Organizations, Enterprises and Institutions (revised 1997)

Chapter I General Provisions Article 1 In order to maintain public order in state organs, social organizations, enterprises and institutions, prevent illegal crimes and public security disasters and accidents, ensure the safety of people's lives and property, and ensure the smooth progress of socialist modernization, these Regulations are formulated in accordance with the provisions of the State Constitution and relevant laws and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to organs, organizations, enterprises, institutions and other units (hereinafter referred to as units) within the municipal area of Nanjing. Article 3 Public security work shall follow the policy of giving priority to prevention, ensuring key points, relying on the masses and comprehensive management. Article 4 Public security work is an important part of unit management, and the principle that factory directors, managers, principals, deans and the main administrative leaders of institutions, organizations and other units are responsible is implemented, and the responsibility system for public security is implemented. Article 5 These Regulations shall be implemented under the leadership of people's governments at all levels, and public security organs at all levels shall be responsible for supervising the implementation. Chapter II Tasks and Systems of Public Security Work Article 6 Units shall incorporate public security work into their management objectives, and arrange, assess, reward and punish work, production, scientific research and teaching at the same time. Seventh units of public security work is the main task:

(a) the legal system and safety education for unit personnel, so that they know the law, abide by the law, correctly exercise their civil rights, consciously perform their civic obligations, and have the courage to fight against illegal and criminal acts;

(two) the implementation of special, anti-theft, fire prevention, explosion prevention, accident prevention and other preventive measures;

(three) to carry out the policy of education, persuasion and salvation, to help and educate those who have minor illegal and criminal acts, and to do a good job in ideological reform;

(four) mediation to deal with internal security disputes, timely guidance, take effective measures to passivate contradictions;

(five) for those who have been released from reeducation through labor and released from prison, they can be placed in employment through various channels and forms;

(six) to strengthen the management of migrant workers, outsourcing workers, temporary workers and training, internship and other personnel, employers and team leaders to develop a responsibility system for public security, do a good job in security;

(seven) to eliminate hidden dangers that hinder public safety;

(eight) to participate in the joint defense of public security organized by local organizations, to carry out joint mediation work, and to maintain public order in the unit and dormitory area. Eighth according to the relevant provisions of the state and the actual situation of the unit, establish and improve and strictly implement the following rules and regulations of public security work:

(a) the guard, duty, patrol, security system;

(2) Key parts of the safety system;

(3) Fire safety system;

(4) Management system for inflammable, explosive, highly toxic, radioactive sources and other dangerous goods and firearms and ammunition;

(five) the confidentiality and management system of confidential products, materials, documents, drawings, materials and seals;

(six) cash, tickets, cultural relics, valuables and vehicle management system;

(seven) the management system of dormitories, hostels, canteens, bathrooms, clubs and other public places;

(eight) safety inspection system;

(9) Safety system for foreign-related work;

(10) Other necessary public security systems. Chapter III Security Organs and Mass Public Security Organizations Article 9 A unit shall set up security organs or be equipped with security cadres according to the relevant provisions of the state and the actual situation of the unit. The establishment and revocation of security institutions and the appointment and removal of their responsible persons shall seek the opinions of public security organs and remain relatively stable.

Units should be equipped with necessary equipment and appliances according to the needs of public security work.

The business funds for public security work should be included in the financial budget of the unit. Article 10 Units shall establish and improve public security organizations such as public security committees, public security teams, voluntary fire brigades, factory protection teams and school guards, and establish economic police and full-time fire brigades in accordance with relevant state regulations. Article 11 The security organ of a unit is the functional department of the unit, which performs the following duties under the direct leadership of the unit and the professional leadership of the public security organ:

(a) to carry out investigation and study, strengthen management measures, rely on and mobilize the masses to do a good job in accident prevention, theft prevention, fire prevention, explosion prevention and destruction prevention, and strictly take various preventive measures to ensure the safety of key parts and maintain internal public order;

(two) to cooperate with the investigation of major accidents, to stop acts that interfere with the production, life and work order of the unit according to law, and to protect the scene and report to the public security organ in time when criminal cases or public security disasters occur;

(three) to lead the work of the economic police, full-time fire brigade and public security committees, public security teams, factory teams, school guards and other mass public security organizations;

(four) to assist the public security organs to investigate and deal with acts of stealing and selling state secrets;

(five) to report the public security work to the public security organs and put forward opinions and suggestions;

(six) to complete other tasks related to public security assigned by the unit and the public security organs. Article 12 The unit security agency shall exercise the following functions and powers:

(1) Assisting in the investigation of criminal cases under the leadership of public security organs;

(two) to assist the public security organs to enforce the ruling on public security punishment and mediate civil disputes;

(3) assisting the public security organs to supervise and inspect criminals sentenced to public surveillance, deprivation of political rights, probation, parole or execution outside prison, and criminal suspects and defendants who are under residential surveillance and released on bail pending trial;

(four) inspection, supervision and assessment of the implementation of the responsibility system for public security, and put forward suggestions for rewards and punishments;

(five) to protect cadres to perform their duties according to law is protected by law, and all relevant departments and personnel should support and cooperate.
