First, how to deal with marital infidelity

1, marital infidelity is handled as follows:

(1) The parties may file a divorce lawsuit with the people's court. If the other party bigamy or cohabitation with others leads to divorce, and mediation is invalid, the court shall grant divorce;

(2) divorce by agreement. After the two parties reach an agreement on issues such as property division and child support, both parties need to go through the divorce formalities at the marriage registration office where either party's household registration is located;

(3) If one party divorces because of bigamy or cohabitation with others, it can be required to pay damages without fault, including mental damages and material damages;

(4) If one party's marital infidelity constitutes bigamy, criminal responsibility shall be investigated.

2. Legal basis: Article 1079 of the Civil Code of People's Republic of China (PRC).

If one of the spouses requests a divorce, the relevant organizations may mediate or directly file a divorce lawsuit with the people's court.

When trying divorce cases, the people's court shall conduct mediation; If the relationship has indeed broken down and mediation is ineffective, divorce should be granted.

In any of the following circumstances, if mediation fails, divorce shall be granted:

(a) bigamy or cohabitation with others;

(2) committing domestic violence or abusing or abandoning family members;

(three) gambling, drug abuse and other bad habits;

(four) separated for two years due to emotional discord;

(5) Other circumstances that lead to the breakdown of the marriage relationship.

If one party is declared missing and the other party files a divorce lawsuit, the divorce shall be granted.

After the people's court ruled that divorce is not allowed, if the two parties have separated for one year and one party files a divorce lawsuit again, divorce shall be granted.

Second, how does the divorce proceedings proceed?

1, the parties file a lawsuit;

2. After allowing the parties to file a case, the filing court will issue a notice of filing, and the court will pay the legal fees with the notice of filing, and the court will formally accept it;

3, by the civil court;

4. After accepting the case, the party concerned issues a summons to the other party;

5. Court mediation;

6. The court made a judgment on whether to grant the divorce through trial.
