What's the difference between rape and indecent assault?

The difference between rape and indecency lies in different definitions, different punishments and different subjective and intentional contents.

I. Different definitions

1. Rape refers to the act of forcing a woman to have sex with her by violence, coercion or other means against her will.

2. Indecency refers to the act of insulting women against their will by violence, threats or other means.

Second, the punishment is different.

1, rape:

Whoever rapes a woman by violence, coercion or other means shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years. Whoever rapes a girl under the age of 14 shall be given a heavier punishment for rape. Whoever rapes a woman or rapes a young girl under any of the following circumstances shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death:

(a) Rape of women and young girls; ?

(2) raping a woman or a number of young girls; ?

(3) raping a woman in public in a public place; ?

(four) gang rape of more than two people; ?

(5) Causing serious injury, death or other serious consequences to the victim (if rape is committed after the victim is violently killed by intentional homicide, the crime of intentional homicide and the crime of insulting the corpse shall be punished in combination). ?

2. Indecency: fixed-term imprisonment of not more than five years or criminal detention. If the criminal object (plaintiff) is a minor, or the criminal subject (defendant) commits a crime in public in a gathering place or public place subjectively, directly and intentionally, he shall be sentenced to fixed-term imprisonment of not less than five years.

Third, the content of subjective intention is different.

1, rape is for the purpose of forced rape.

2. The crime of indecency is not aimed at forced adultery.
