The car was spray-painted and dragged along the street. What happened?

On March 17, multiple videos of car smashing were frequently forwarded in WeChat Moments.

A vehicle with a Nanjing license plate was first trampled and kicked in the parking lot, causing serious damage to the vehicle. After that, the vehicle was forced to be dragged on the road, resulting in the destruction of four tires and the loss of the wheel hub. Half worn away.

The lawyer said that the person who destroyed the car has been suspected of a criminal offense.

One of the three viral videos showed that the date posted on the video website was 8:31 a.m. on March 13.

The video shows a man walking through a parking lot, walking straight towards a golden car, and then spray-painted the words "Two hundred and five, two hundred and five, two hundred and five". He then kicked both doors on the left side of the car, jumped up on the hood and kicked the front windshield.

Towards the end of the video, the man spray-painted the word "idiot" on the hood and made a "V" hand gesture on the screen to show victory.

Since then, two other videos have appeared online, one of which shows the car being forcibly towed away.

All four tires of the car were scrapped and the wheels were forcibly dragged to the ground. The video, said to have been taken by a passerby on his mobile phone, shows a strong smell of rubber that the photographer said could be smelled at the scene.

Another video showed that the car was parked on the side of the road. Some of the tires had disappeared, and nearly half of the remaining wheel hubs had been worn away. It attracted a large number of onlookers, and the hood was re-sprayed. The words "people die for money" were used.

The price of the destroyed vehicle is about three to four hundred thousand yuan. The reporter contacted the car owner. But the other party told reporters on the phone that this was a family dispute and said it was a private matter and did not want to be interviewed.

Relevant professionals said that it can be seen from the video that after the car was destroyed, the repair cost will be as high as tens of thousands of yuan.

A lawyer from a Jiangsu law firm said that judging from the existing video and the degree of vehicle destruction, the party who deliberately destroyed the vehicle has met the filing standards for the crime of intentional destruction of property, and the police should pursue criminal responsibility in accordance with the law.

The so-called crime of intentional destruction of property refers to behavior that intentionally destroys or damages public or private property, involving a relatively large amount or involving other serious circumstances. According to the provisions of Article 275 of the "Criminal Law of the People's Republic of China", whoever intentionally destroys or damages public or private property, and the amount is relatively large, or there are other serious circumstances, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, or a fine. Anyone who intentionally destroys public or private property, involving a huge amount or having other particularly serious circumstances shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years.

Of course, if the car owner is not held accountable or the party’s understanding is obtained, the criminal penalty for the party can be reduced or exempted.
