Can I change lawyers after the trial?

Legal analysis: Whether it is a criminal lawsuit or a civil lawsuit, the parties have the right to change their lawyers after the trial, but the number of changes and other matters need to depend on the nature of the case. In civil litigation, if a party changes his lawyer or the power of attorney is changed or revoked, it shall notify the people's court in writing, and the people's court shall notify the other party. The parties only need to apply for change notification. For criminal proceedings, the defendant may refuse the defender to continue to defend him, or entrust other defenders to defend him, but generally not more than twice, otherwise the parties will defend themselves. If the defendant refuses to entrust a lawyer to defend a case in which legal aid should be provided, the people's court shall find out the reasons, and if the reasons are justified, it may allow it. If it is filed again after replacement, the people's court shall not allow it.

Legal basis: Article 60 of the Civil Procedure Law of People's Republic of China (PRC), if the authority of an agent ad litem is changed or revoked, the parties shall notify the people's court in writing, and the people's court shall notify the other party.

Article 50 If the defendant refuses the lawyer appointed by the legal aid institution to defend him and insists on exercising the right of defense, the people's court shall allow it.

If the reason is justified, it shall be allowed, but the defendant shall entrust another defender within five days; If the defendant fails to entrust a defender, the people's court shall notify the legal aid institution to appoint another lawyer to defend him within three days.

Article 311 During the trial, the defendant may not change his defender more than twice.

If the defendant refuses the defender to defend in court and requests to entrust another defender or appoint a lawyer, the collegial panel shall allow it. After the defendant refuses the defender's defense, if there is no defender, he shall announce an adjournment; If there are defenders, the trial can continue.

In the case of multiple defendants, if some defendants refuse to be defended by defenders and there is no defender, they can be handled separately according to the circumstances of the case, and the trials of other defendants will continue.

After the new court session, if the defendant refuses the defender to appear in court again, it may be allowed, but the defendant may not entrust another defender or ask for another lawyer to defend himself.

If the defendant is in a situation where legal aid should be provided and refuses the defender to appear in court again after the retrial, it will not be allowed.
