Article 1 In order to strengthen the safety management of fireworks and firecrackers, effectively protect the safety of people's lives and property, and effectively prevent environmental pollution and noise pollution, these Provisions are formulated according to the Law of People's Republic of China (PRC) on Public Security Administration Punishment, the Regulations of the State Council on the Safety Management of Fireworks and Firecrackers, the Regulations of Hebei Province on the Prevention and Control of Air Pollution, the safety and quality of fireworks and firecrackers, and other relevant laws and regulations, combined with the actual situation of our city.
Article 2 "Fireworks and firecrackers" as mentioned in these Provisions refers to inflammable and explosive articles which use pyrotechnics as the main raw materials and produce effects such as light, sound, color, shape and smoke through burning or explosion after being ignited.
Article 3 It is forbidden to set off all kinds of fireworks and firecrackers throughout the year within the administrative area of the whole city.
Fourth within the administrative area of this Municipality, the sale of fireworks and firecrackers is prohibited throughout the year. It is forbidden to set up retail outlets for fireworks and firecrackers.
Fifth major festivals and important celebrations, celebrations really need to hold large-scale fireworks display activities, such as fireworks parties, should be issued by the public security organs in accordance with the relevant provisions of the "fireworks display permit."
Article 6 Whoever sets off fireworks and firecrackers in violation of these regulations shall be ordered by the public security department to stop the fireworks and firecrackers in accordance with the second paragraph of Article 42 of the Regulations on the Safety Management of Fireworks and Firecrackers, and shall be imposed a fine of more than 65,438 yuan in 500 yuan. If it constitutes a violation of public security administration, it may be fined for more than 15 days according to Article 30 of the People's Republic of China (PRC) Public Security Administration Punishment Law. If large-scale fireworks display activities such as fireworks parties are held without permission, or the fireworks display operation units and workers violate the fireworks display safety regulations and the fireworks display operation plan, the public security department shall order them to stop the fireworks display according to the first paragraph of Article 42 of the Regulations on the Safety Management of Fireworks and Firecrackers, and impose a fine of 6,543,800 yuan to 50,000 yuan on the responsible units.
Seventh in violation of the provisions, causing property losses or personal injury to the state, the collective or others, shall bear civil liability according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Eighth in violation of the provisions of the act, any unit or individual has the right to persuade and stop and report. Those who report illegal fireworks and firecrackers will be praised and rewarded after verification, and the specific amount will be given 200- 1000 yuan depending on the circumstances.
Article 9 The municipal government shall set up Yongzhou Office for Prohibiting Fireworks and Firecrackers, located in the Municipal Public Security Bureau, to co-ordinate the work of prohibiting fireworks and firecrackers in the whole city. City Ban Ban Ban Office is under the unified command of Municipal Public Security Bureau, Emergency Management Bureau, Urban Management Comprehensive Administrative Law Enforcement Bureau, Market Supervision Bureau, Ecological Environment Bureau, Transportation Bureau, Supply and Marketing Cooperative, Civil Affairs Bureau, Education and Sports Bureau, State Administration of Culture, Radio, Film and Television, Tourism Bureau and other departments as well as towns, offices, development zones and neighborhood committees. Article 10 These Provisions shall come into force as of the date of promulgation and have long-term effectiveness. The Provisions of Tianzhou Municipality on Prohibiting and Restricting the Sale and Setting off Fireworks and Firecrackers (1No.) issued by the Municipal People's Government on October 3, 2020 shall be abolished at the same time.
