Police auxiliaries are part of the labor force and are subject to labor laws and do not have the qualifications to be law enforcement entities.
The provisions of Chapter 16 of the Civil Servant Law shall apply to the recruitment of Public Security Bureau personnel.
Article 95
According to work needs and with the approval of the civil servants department at or above the provincial level, agencies may implement an appointment system for highly professional positions and auxiliary positions.
If the positions listed in the preceding paragraph involve state secrets, the appointment system will not be implemented.
Article 96?
Civil servants under the government appointment system can be openly recruited according to the civil service examination procedures, or they can be directly selected from qualified personnel.
The appointment of civil servants by government agencies shall be within the prescribed staffing quota and salary funds.
Article 97
When an agency recruits a civil servant, it shall sign a written employment contract based on the principles of equality, voluntariness, and consensus through consultation to determine the rights and obligations of both the agency and the civil servant. The employment contract can be changed or terminated by consensus reached by both parties.
The signing, modification or termination of an employment contract shall be reported to the civil servants department at the same level for filing.
Article 98
The labor contract shall include terms such as contract period, job responsibilities, wages, benefits, insurance benefits and liability for breach of contract.
The term of an employment contract ranges from one to five years. The labor contract can stipulate a probation period, which can range from one month to six months.
Civil servants shall be appointed in accordance with national regulations, and specific measures shall be formulated by the central civil service department.
Article 99
Official agencies shall manage the civil servants they employ in accordance with this Law and the employment contract. ,
Article 100: The state establishes an arbitration system for personnel disputes.
Arbitration of personnel disputes should follow the principles of legality, fairness and timely handling, and safeguard the legitimate rights and interests of both parties to the dispute in accordance with the law.
Establish a personnel dispute arbitration committee as necessary. The personnel dispute arbitration committee is composed of representatives of the civil service department, the employer, representatives of the appointment-based civil servants, and legal experts.
If a dispute arises between an employed civil servant and his or her public institution due to the performance of the employment contract, he or she may apply to the Personnel Dispute Arbitration Commission for arbitration within 60 days from the date of occurrence of the dispute. If a party is dissatisfied with the arbitration award, it may file a lawsuit with the People's Court within 15 days from the date of receipt of the arbitration award. After the arbitration award takes effect, if one party fails to perform, the other party may apply to the People's Court for enforcement.
