Not long ago, after Jiang, the acting chairman of our trade union, came to your office to reflect the administrative inaction of the Fushan District Labor and Social Security Bureau (hereinafter referred to as the Labor Bureau) in safeguarding its legitimate rights and interests, Zhang Jun, a staff member of our trade union, came to your office again on February 27th, 2007 to reflect the corresponding situation. You told us that the trade union should prepare a written document first, and now we are submitting the letter to you. Details are as follows:

Olivier (Yantai) Electronics Co., Ltd. (hereinafter referred to as Olivier Company) has been seriously violating the labor law since it was established in Fushan High-tech Industrial Zone in the second half of 2005, which has greatly infringed upon the legitimate rights and interests of our employees. Workers have repeatedly complained to the Fushan District Labor Bureau about labor supervision, but they have not been dealt with by the Labor Bureau according to law, especially on February 10, 2006, the workers of Olivier Company filed a written complaint with the Fushan District Labor Bureau. It is precisely because of the administrative inaction of the Labor Bureau that Olivier Company illegally dismissed as many as 57 workers on April 28, 2006, that is, on the eve of Labor Day. On April 29th, when the workers illegally dismissed by Olivier Company complained to the Labor Bureau again, Olivier Company illegally dismissed 10 female workers. This case was published in Yantai Evening News on May 1 2006, which aroused strong social repercussions. However, Olivier Company did not restrain its illegal activities at all, and continued to violate the labor law, arbitrarily dismissing my workers, not signing labor contracts for most Olivier workers and paying labor insurance fees.

Faced with the serious violation of the labor law and the administrative inaction of the labor bureau, the workers of Olivier Company began to decide to set up trade unions to safeguard their legitimate rights and interests. From June to July, 2006, the workers of Olivier Company repeatedly asked Fushan District Federation of Trade Unions and Olivier Company to form a trade union, but all of them were rejected by Olivier Company. Helpless, the workers held a strike movement to form a trade union, which was directly supported by the All-China Federation of Trade Unions. After the victory of the strike, our trade union was established according to law. After the establishment of our trade union, we insisted on safeguarding the legitimate rights and interests of workers in accordance with the law, resisted difficulties and pressures, and refused to be a yellow dog trade union. Olivier also told us what a strike trade union is, which is illegal. The company refused to admit it, and even mobilized our trade union chairman to take revenge. In response to this incident, our trade union specially gave six workers (for the establishment of our trade union, it fully shows that the strike movement for the establishment of our trade union is protected and supported by law, and it also completely shattered the wrong statement that it is illegal to strike for the establishment of our trade union. In March 2007, two foreign managers of Olivier Company said to the chairman of our trade union: Ask our trade union to make an offer. How much can we cancel our trade union? Of course, it was rejected by my union. Later, Olivier made a decision to expel the chairman of our trade union. At that time, Olivier refused to renew the labor contract for the workers. In this case, our trade union led the workers to go on strike, which was understood and supported by the relevant staff of the superior Federation of Trade Unions and the Labor Bureau. The strike won again, and our trade union chairman returned to work. At the same time, Olivier also renewed the labor contract for the workers.

On June 6, 2007, Jiang Yinwei, the acting chairman of our trade union, was retaliated by Olivier Company for protecting workers' rights and interests. On June 7th, Olivier Company made an illegal decision and fired eight people, including the chairman of our trade union. The Labor Bureau accepted the case in June 5438 +2007 10, and characterized Olivier's illegal dismissal of the chairman of our trade union as retaliation, and issued a rectification instruction to Olivier in June 5438 +2007 10. Later, Olivier approached the chairman of our trade union: after planning to pay twice the compensation to our trade union chairman, he asked our trade union chairman to resign and leave. Rejected by the chairman of our trade union. Our trade union went to the labor bureau for protection, and the labor bureau refused to perform its administrative duties on the grounds that it was legal for Olivier to pay twice the compensation to our trade union chairman.

Because the Labor Bureau characterized olivier's illegal dismissal of our trade union as retaliation, according to the laws provided in the annex (see below), our trade union believes that there is serious administrative inaction in the Labor Bureau. If the labor bureau refuses to perform its duties for the right reasons, it will inevitably lead to the existence of these laws in name only, which also violates the legislative purpose of legislators. More seriously, it encourages enterprises to illegally dismiss the chairmen of grass-roots trade unions who dare to defend workers' rights.

Our trade union requires the Labor Bureau to perform its duties, and let the chairman of our trade union return to his original post in Olivier Company, and reissue his salary and other remuneration during his illegal dismissal by Olivier Company.

Article 51 of the Trade Union Law of People's Republic of China (PRC) violates the provisions of this law and retaliates against trade union workers who perform their duties according to law without justifiable reasons, and the labor administrative department shall order them to make corrections and restore their original posts; If losses are caused, compensation shall be made. Insult, slander or personal injury to trade union staff who perform their duties according to law, which constitutes a crime, shall be investigated for criminal responsibility according to law; If it does not constitute a crime, it shall be punished by the public security organ in accordance with the regulations on administrative penalties for public security.

Article 52 In case of any of the following circumstances, in violation of the provisions of this Law, the labor administrative department shall order him to return to work, make up the labor remuneration payable during the termination of the labor contract, or order him to pay compensation twice his annual income:

(1) Employees are terminated due to their participation in trade union activities;

(2) Trade union workers terminate their labor contracts because they perform their duties as stipulated in this Law.

Article 29 of the Regulations on Labor Security Supervision stipulates that if an employer violates the Trade Union Law of People's Republic of China (PRC) and commits one of the following acts, the administrative department of labor security shall order it to make corrections:

(1) Obstructing laborers from joining and organizing trade unions according to law, or obstructing superior trade unions from helping and guiding laborers to establish trade unions;

(two) to mobilize the trade union staff to perform their duties according to law and take revenge without justifiable reasons;

(3) The employee's labor contract is terminated due to his participation in trade union activities;

(four) the labor contract is terminated by the trade union staff for performing their duties according to law.

Interim Measures for the Protection of the Legitimate Rights and Interests of the Chairman of the Enterprise Trade Union "If the chairman of the enterprise trade union is dissolved or terminated by the enterprise without justifiable reasons because he performs his duties according to law, the superior trade union shall urge the enterprise to continue to perform his labor contract according to law, resume his original post work, reissue the remuneration due during the period of dissolving the labor contract, or give him compensation twice his annual income, and give him economic compensation when dissolving or terminating the labor contract."
