Article 3 of the Supreme People's Court's "Interpretation on Several Issues Concerning the Application of Law in the Trial of Refusal to Enforce Judgments and Rulings in Criminal Cases" stipulates that if the person applying for execution has evidence to prove that he has the following circumstances, the People's Court considers that it is consistent with criminal proceedings If the third paragraph of Article 204 of the Law stipulates, a private prosecution trial shall be initiated:
(1) The person who is obliged to execute refuses to execute the judgment or order, and infringes upon the personal and property rights of the person applying for execution, and shall be prosecuted in accordance with the law. Pursuance of criminal liability;
(2) The person applying for execution has filed a complaint, but the public security organ or the People's Procuratorate does not pursue the criminal liability of the person with execution obligations.
