1. "Do you want to apply for enforcement by yourself or by a lawyer?" You don't ask for a lawyer to apply, you can apply for it yourself. However, it should be noted that citizens who apply for enforcement shall not be accepted within 2 years after the judgment takes effect. 2. "Is it necessary to apply for enforcement?" : (1) Copies of valid legal documents and ID cards, but the originals should also be brought, and the court will review them. (2) If the application for execution can provide accurate clues about the property of the person subjected to execution, the execution speed will be faster. 3. "How long will it take to enforce?" It's hard to say. If the person subjected to execution has enough property for execution and the enforcement judge is not busy at this stage, the execution can be completed within one month. But if there is no property available for execution, it will not be completed in ten or eight years. After accepting the case, it shall send a notice of execution to the person subjected to execution within 3 days, and specify a time limit for the person subjected to execution in the notice of execution. If the other party fails to execute the judgment after the time specified in the execution notice, enforcement measures will be taken. The basis is: (` 1) Article 216 of the Civil Procedure Law: "Upon receiving an application for execution or an execution transfer, the executor shall issue an execution notice to the person subjected to execution and order him to perform it within a time limit. If it fails to perform within the time limit, it is compulsory to perform the obligations specified in the legal documents, and it is possible to conceal or transfer the property, and the executor may immediately take compulsory measures. " (2) Article 24 of the Provisions of the Supreme People's Court on Several Issues Concerning the Enforcement of People's Courts (for Trial Implementation): "After the people's court decides to accept an enforcement case, it shall issue an enforcement notice to the person subjected to execution within three days, ordering him to perform the obligations specified in the effective legal documents within a specified time limit, and bear the debt interest or delayed payment during the delay period stipulated in Article 232 of the Civil Procedure Law. In addition, the people's court shall submit an application that meets the above conditions within seven days; If one of the above conditions is not met, it shall be ruled inadmissible within seven days. " (2) If the court fails to take enforcement measures within 6 months after accepting your application, you can apply to a higher court for upgrading. The basis is: Article 203 of the Civil Procedure Law: "If the people's court fails to execute the application for execution for more than six months from the date of receiving the application for execution, the executor of the application may apply to the people's court at the next higher level for execution.
