If criminal liability is discovered in civil litigation, any unit or individual can report it to the public security organ, the People's Procuratorate or the People's Court. If it is a private prosecution case, the victim has the right to file a lawsuit directly with the People's Court.
Legal objectivity:
Article 172 of the Civil Code of the People's Republic of China shall submit a petition for appeal. The content of the appeal shall include the names of the parties, legal persons and their legal representatives or other organizations and their principal persons in charge; the name, case number and cause of the case of the original people's court; and the request and reasons for the appeal. Article 173 of the "General Principles of the Civil Law of the People's Republic of China" stipulates that if a case is filed by the original People's Court, copies shall be submitted according to the number of parties or representatives of the other party. If a party appeals directly to the People's Court of second instance, the People's Court of second instance shall transfer the appeal petition to the People's Court of original instance within five days.
