There is no time limit for criminal complaint, that is, the criminal procedure law does not stipulate the time limit for the complainant to file a criminal complaint. No matter how long the case is handled, the complainant can file a criminal complaint. In civil proceedings, the parties applying for retrial shall file the application within two years after the judgment or ruling becomes legally effective. The purpose is to urge the parties to actively exercise their right to apply for retrial. If the time interval between the application for retrial and the effective date of the original judgment or ruling is too long, it will bring many disadvantages to the retrial work. However, the people's courts and people's procuratorates are not restricted by the expectation of applying for retrial.
