Legal basis: Provisions on Procedures of Public Security Organs Handling Criminal Cases
Article 284 The public security organ shall comprehensively examine the evidence materials that prove the legality of the collection of evidence and exclude illegal evidence according to law. If the evidence is insufficient after excluding illegal evidence, it shall not be transferred for review and prosecution.
If the public security organ finds that investigators illegally collect evidence, it shall deal with it according to law, and may assign investigators to re-investigate and collect evidence.
Article 285 After a case is closed, the investigators shall make a closing report.
The closing report shall include the following contents:
(1) Basic information about the criminal suspect;
(two) whether compulsory measures have been taken and the reasons;
(3) The facts and evidence of the case;
(4) Legal basis and handling opinions.
