On the first day of work, the President assigned us two interns the task of sorting out the files. This is a boring mechanical work, and it can also be said that it is a necessary subject for our law students to practice. It seems to be a simple classification, but each file includes documents such as filing review form, notice of acceptance, notice of responding to the lawsuit, identification of the parties, evidence materials, transcripts, mediation or ruling, summons, receipt of service, etc., and should be placed in the prescribed order, excluding unnecessary documents. Because there are many cases in the old city court, the workload can be said to be quite large.
On the first day of internship, I was working hard, and time passed quietly. There was no special feeling or touching story, and everything was very natural. It is the most important thing for me at the beginning of my internship to be able to integrate into the courtroom work and enter the role as soon as possible. In this sense, the first day was a great success.
Old Town Court is a dispatch court of Chengmai County Court. It is small in place and has many things. Although the division of labor is not clear enough, it makes me look forward to learning more in a short internship day. It is said that I have learned a lot from internships in grass-roots courts, especially in courts. It is true that in rural areas, the amount involved in civil cases is generally not very large, but these cases are relatively complicated. Many things that rural people maintain communication cannot be put on paper, and there are many habits based on trust and moral concepts. Once these habits continue, but trust and morality are destroyed, it is difficult to prove these problems. Life facts are more difficult to recover, and legal facts are more difficult to identify. The result is the difficulty and complexity of the case, and many interpersonal factors are entangled in it, which is difficult to sort out, which is really difficult for judges.
President Zeng is a very patient judge. He told us that the most common thing in court is not to hold a court session, but for the parties to chat with the judge. Judges should be well-intentioned and well-founded, let them constantly reflect and finally help them solve problems. However, not all the parties are so easy to "tame". After all they have said and talked about, they are unwilling to cooperate and expect to get the court's judgment as soon as possible. There are still some parties who have deep grievances, and the lawsuit is to fight for breath. Of course, they can't agree to mediation. It depends on the judge's mediation skills.
The methods and skills of mediation are really a science. It is said that the success rate of mediation in old city courts is very high and good social effects have been achieved. It seems that I can take this opportunity to learn more mediation skills from the president and other judges.
I have gained a lot on the first day. I hope I can continue to refuel in the future, and make this graduation internship a valuable asset in my undergraduate study career.
arraignment on Monday, May 9th, 2114
Today is the third day when I came to the procuratorate. In everyone's opinion, the whole volume of tedious work is so boring, but I am still doing it in an orderly way. People who have been with me for a long time will know that I don't like to complain. Once I do it myself, I will always try my best to finish it, no matter whether it is difficult or easy. Maybe you think I am stupid, but I am such a person. People in the department probably saw my temper and said they wanted me to relax and decided to take me to the arraignment.
Although it's not the first internship, it's not the first time for me to be arraigned, but I feel indescribable excitement in my heart. As usual, I read the file carefully before arraignment, got the file, and saw on the cover that XXX was intentionally injured, which reminded me that I might have been detained for fighting, but I read the file carefully, but it was not. It was a traffic accident, so how could the public security organ report the arrest for intentional injury? So I carefully dug up every detail, and finally I found that the road closure notice of the highway management department was attached at the end of the file, and it happened that this traffic accident happened on this closed road. So I carefully asked the case handlers whether the reason for this conviction was what they thought, and the result was yes, but such a case was easily misled into a traffic accident in the study. Although the punishment of these two charges was equivalent, they were completely different concepts. Such a good case may only be found in the internship.
