Fight. Net terms of use were last updated on June 25th, 2009. Please read all the following carefully (especially those underlined in bold).

Thank you for using Battle.net Service (referred to as "Battle.net Service"). This Terms of Use (hereinafter referred to as "TOU" or "Terms") is a legal agreement between you and Shanghai Netease Network Technology Development Co., Ltd., which stipulates that you will have the right to use Battle.net services on the premise of observing the provisions of this clause. Blizzard Entertainment Limited (a company established in Delaware, USA) (and its subsidiaries and licensors, collectively referred to as "Blizzard") is the copyright owner of Battle.net Services. Shanghai Netease Network Technology Development Co., Ltd. was designated by Blizzard as an independent and exclusive distributor of Battle.net services in People's Republic of China (PRC) (excluding Taiwan Province Province, Hong Kong Special Administrative Region and Macao Special Administrative Region). Shanghai Netease Network Technology Development Co., Ltd. is an affiliated company of Netease Company (NetEase.com, Inc.). For convenience, Shanghai Netease Network Technology Development Co., Ltd. is referred to as "Netease" or "We" for short. This clause cannot replace the End User License Agreement ("EULA") contained in Blizzard Games ("Games"), nor can it replace the effectiveness of other exclusive terms of use for games. EULA is an agreement that restricts you from using the game client (a part of the game program installed on your computer), and this clause is an agreement that restricts you from using Battle.net services.

Battle.net was granted a limited service license. You must agree to and abide by the terms of this Terms and Conditions before you can use the Battle.net service by using an unauthorized web browser or an officially recognized game client. You can only use the Battle.net service for non-commercial entertainment purposes, but not for other purposes or by other means.

Additional licensing restrictions. The license granted to you in Article 1 will be subject to the restrictions stipulated in Article 1 and Article 2 (collectively referred to as "license restrictions"). When using Battle.net services or games, any violation of licensing restrictions will be regarded as infringement of Blizzard's game copyright. You agree that under no circumstances will you:

Use cheat software (Cheat), robot program software (bot), hacker program software (hack), game enhancement program (mod) or other unauthorized third-party software to modify Battle.net service, modify the game or interfere with the game experience;

Obtain commercial profits by using Battle.net services or games or any content contained therein, including but not limited to (a) conducting such activities in Internet cafes, computer game centers or other commercial places without the written consent of Netease and/or Blizzard; (b) Disseminating or assisting in the dissemination of commercial advertisements or committing similar abetting acts; (c) collecting game coins, commodities or resources for offline sales without the authorization of Netease and/or Blizzard; Or (d) receiving remuneration offline by providing online services, such as acting as a substitute;

Use unauthorized third-party software (including but not limited to any software that can read the storage area of the game or Battle.net service to store information about the game characters or game environment) to intercept, mine or otherwise collect information from the game or Battle.net service; However, Netease and/or Blizzard have the right to independently decide whether to allow you to use some third-party user interfaces;

Modify any component files of the game or battle. Net service or modify the above documents in any way without the express approval of Netease and/or Blizzard;

Use any means to build a host for Blizzard games or battles. Net services, providing or developing matching services, or intercepting, imitating or redirecting the communication protocols used by Blizzard and/or Netease for some purpose, including but not limited to unauthorized game behaviors through the Internet, networked warfare or content aggregation networks;

Assist, create or maintain any unauthorized connection with games or Battle.net services, including but not limited to: (a) any unauthorized server that imitates or attempts to imitate Battle.net services or games; And (b) any connection using programs or tools that have not been explicitly approved by Blizzard and/or Netease; or

Interference and assistance to interfere with (i) any computer (hereinafter referred to as the "server") used to provide Battle.net services or game services; Or (ii) other players play normally. Any attempt to interfere with Battle.net's service or disrupt the normal operation of the game may violate criminal law and civil law.

Reverse engineering, reverse compiling or disassembling games or battles. Network services for any purpose.

Prerequisite. Before using Battle.net Service, you must (i) agree to these terms, privacy policy and applicable terms of use, end-user license agreement and in-game policy of each game used in Battle.net Service; (ii) purchase a valid license for the game that will use the Battle.net service; And (iii) registration of a pass for service in Battle.net ("Battle.net Pass"). You are obligated to pay the internet fee and other fees incurred when using Battle.net service. Minors' use of Battle.net services will be subject to the relevant laws, regulations, rules and policies of People's Republic of China (PRC) (including but not limited to restrictions on game addiction prevention and real-name authentication).

Get services.

Qualified. You must be a natural person to create a Battle.net Pass. Companies, limited companies, partnerships or other legal or commercial entities may not make Battle.net Pass. Individuals who are banned from using Battle.net services by Blizzard or Netease are not allowed to create or use Battle.net Pass, otherwise they may be severely punished by civil law and criminal law. If you accept this clause, you hereby guarantee that you meet the above prerequisites for creating a package.

Create a pass. When creating or updating Battle.net Battle.net Pass service, you need to provide some personal information to Netease, such as your name, address, telephone number, e-mail address and payment information in some cases. For some games (the specific scope of application is decided by Netease and Blizzard), an unused activation code provided by Netease is needed when adding game authorization to the pass. In this case, before you start playing online games, you must add a game license to the Battle.net Pass. You hereby agree that if the relevant information changes, you will provide accurate and complete information and update the information provided in time. When you apply to bind your game account to Battle.net Pass, we will ask you to provide true and valid identity information or relevant documents, so that we can check and confirm that you are a legally registered user of the game account and judge the legality, legitimacy and rationality of the game account activities.

User name and password. In the process of creating Battle.net Pass, you will be asked to select a unique user name and/or password (collectively referred to as "login information"); You shouldn't use combat. Net pass or login information with anyone other than the person specified in this article. You have the obligation to keep your login information confidential, and you are responsible for all actions (including trading actions) conducted by using your login information, regardless of whether these actions are authorized by you or not.

Attention. If you find or reasonably suspect that there are loopholes in the security of login information (including but not limited to loss, theft or unauthorized disclosure), you must immediately send an email to inform us (email: /support).

The end or cancellation of a battle. Net transmission. Blizzard and/or Netease may temporarily suspend, permanently suspend, modify or delete the Battle.net Pass under certain circumstances (for example, in violation of this Agreement, the end-user license agreement of the game or other policies of Netease and/or Blizzard, or in order for Netease and/or Blizzard to comply with applicable laws or decrees issued by the local government). In particular, in the process of binding the game account with the Battle.net Pass, if Blizzard and/or Netease think that the game account you requested to bind is suspected of fraud, false statement, violation of the provisions of this clause, improper behavior, dishonesty or other behaviors that affect the integrity of the game service, Blizzard and/or Netease have the right to refuse to provide binding services and take measures to deal with these accounts, including but not limited to temporarily or permanently banning the game account. Fight. A network pass that has been permanently banned due to any form of combat abuse. Network Pass (including but not limited to violation of this clause) will not be reactivated. You can cancel your registered Battle.net Pass at any time according to the instructions on the Battle.net website. No matter whether you unilaterally terminate this agreement in advance or Netease terminates this agreement in advance due to your violation of the terms of use or other policies of Netease or Blizzard Entertainment, you hereby make an irrevocable commitment: after the termination of these terms of use, you will use all the advance payment and remaining game time in your account as liquidated damages to compensate Netease for such breach of contract, and Netease has no obligation to transfer, refund or compensate you for such advance payment or remaining game time; If such liquidated damages are not enough to make up for Netease's losses, Netease has the right to claim further compensation from you. You understand that providing services in Battle.net is the commercial decision of Blizzard and Netease, and Blizzard or Netease has the right to modify, suspend or terminate the provision of services and/or service support at any time according to the actual needs at that time. You hereby agree that Netease and Blizzard are not responsible for this.

Update.

Agreement. This agreement will be continuously updated while improving the service. After the update, the next time you use Battle.net service, you will be prompted to agree or reject the modified agreement. If you choose to continue using the Battle.net service, you must agree to all changes. Other policies may be added and/or revised from time to time, including but not limited to the code of conduct, other in-game policies and privacy policies, and the updated version will be published on the website of Battle.net. If you don't agree with the terms of use, any code of conduct, privacy policy and the current version of other policies specified by Netease and/or Blizzard related to the Battle.net service, you must immediately stop using the Battle.net service.

Software and services. In order to improve the quality of products and services, we may ask you to download and install the games and Battle.net service updates installed on your computer. You confirm and agree that we can update Battle.net services and games (including game clients stored in your computer) at any time, whether we notify you in advance or not.

Ownership.

Game client and Battle.net service. Game client and Battle.net services (including but not limited to any subtitles, computer codes, themes, objects, game characters, game character names, story contents, conversation contents, buzzwords, game concepts, art works, animations, sound effects, music, audio-visual effects, calculation methods, personality rights, documents, online chat records, game character data information, game duration recorded by the client, game clients and. Blizzard and Netease reserve all rights related to games and Battle.net services, including but not limited to the exclusive right of Blizzard to create derivative products. You agree that you will not create any products based on games or battles. Online service, unless there is a clear agreement in the competition rules or fan policies (including but not limited to the game movie policy or fan art submission policy) that are in effect at that time. Any act of copying or redistributing Blizzard games in violation of these terms or agreements (including but not limited to the game end-user license agreement and terms of use) is explicitly prohibited by law and may be severely punished by criminal law and civil law.

Fight. Notwithstanding anything to the contrary in this clause, you know and agree that you have no ownership, property rights or other related interests in the Battle.net Pass. You further confirm and agree that all the rights contained in and related to the Battle.net Pass belong to Blizzard and will always belong to Blizzard, and Netease is authorized to use the above contents. We don't recognize the transfer of Battle.net Pass. You are not allowed to buy, sell, give away or trade any battles. Net pass, or try to buy, sell, give away or trade any fight. Net transmission. All the above actions are considered invalid.

User and game data. Your personal data, account data and all other relevant information, including the game characters and goods in your account, are owned by Blizzard and/or Netease. You hereby agree and confirm that the privacy policy will further stipulate the provision, disclosure or transfer of such data.

Virtual objects. Blizzard or Netease owns the ownership, license or other rights of all the contents appearing in Battle.net services and games. You agree that you have no ownership or any other rights to the above contents (including but not limited to the virtual goods and money appearing or generated in the game, other attribute information related to this pass or stored in the Battle.net service). We do not recognize any so-called transfer of virtual property outside the game, nor do we recognize any so-called sale, gift or transaction of the content appearing or produced in the game in the "real world", unless the above actions have been explicitly authorized in writing by Netease and/or Blizzard. Therefore, unless you get the written permission from Netease and/or Blizzard, you are not allowed to sell in-game items or currencies in exchange for "real" currencies, or exchange such items and currencies with real items outside the game in an equivalent way.

Expenses. You hereby agree to pay all fees and taxes arising from the use of your registered Battle.net Pass by yourself or others. If you choose the automatic renewal payment method for any game, it means that you agree to automatically deduct the relevant fees (that is, the fees will be deducted from your account or credited to your credit card account). Fees for goods and services provided by Battle.net Service may be adjusted from time to time, including but not limited to subscription fees for any games. You confirm that you have no right to request the refund of any advance payment made on behalf of Battle.net Pass.

Transfer of game license.

According to the independent decisions of Netease and Blizzard, some game clients may need to enter an activation code. The activation code of the matching game client can only be used once, and the Battle.net account registered with the activation code will be authorized for the corresponding game. The transferability of the game client license will be subject to the provisions of the end-user license agreement of the game; However, the transfer of any game client will not affect your registration. Network transmission, and fight. Net transmission shall not be transferred together with the game client. Users who purchase the second-hand game client license should follow the detailed steps on the website (), and may need to pay a certain handling fee.

Use restrictions and conditions

Do not violate the law. You agree that you will not violate any applicable laws and regulations when using the game client or Battle.net service. Not limited to the above matters, you will not provide any materials or information that may infringe the copyright, trademark right, patent right, trade secret or other rights (including personal privacy and publicity right) of a third party through Battle.net Service.

Abuse of services. You shall not connect or use the Battle.net Service in any way that is not expressly permitted in this Agreement. Not limited to the above matters, you agree not to initiate, assist or participate in any form of attack, including but not limited to (a) attacking Battle.net service, trying to interrupt Battle.net service or preventing others from using Battle.net service normally; (b) Unauthorized attempts to use the Battle.net service, another person's registered Battle.net pass or access the computer system or network related to the Battle.net service.

Data collection is not allowed. You agree that you will not (a) obtain or attempt to obtain information from Battle.net Service or any game in any way without the express permission of Netease and/or Blizzard; (b) Interception, inspection or observation of any proprietary communication protocol used by customers or Battle.net services, whether through the use of network analyzers, packet bugs or other devices; (c) Use any third-party software to collect information from/through the game client or Battle.net service, including but not limited to your character information, any Battle.net pass information registered by you, virtual goods information, other player information or all other game data.

User content. "User-related content" refers to any communication information, images, sounds and all materials and information uploaded or transmitted by you or other users through the game client or Battle.net service, including but not limited to any chat records. You hereby grant Blizzard and Netease a permanent, irrevocable, worldwide, paid and non-exclusive license, including the right to sublicense, copy, revise, adapt, modify, translate, recompile, create derivative works, manufacture, introduce circulation, publish, distribute, sell, license, transfer, lease, spread and publicly display to third parties. To the maximum extent permitted by applicable laws, you hereby waive all personal rights you may enjoy in the content of this user.

Content review and disclosure. We will not and cannot check or monitor all user content in advance. However, when you use Battle.net services or games, our staff will monitor and/or record your communication information (including but not limited to chat text), and you hereby give irrevocable permission for the above monitoring and recording. You confirm that you have no privacy expectations for any user content (including but not limited to chat text or voice communication information). We do not assume any responsibility or obligation for user content generated by users. We have the right (but not the obligation) to decide whether to edit, refuse to publish or delete any user content at our own discretion. At the same time, we reserve the right to decide whether to disclose any user content and other information (including but not limited to chat text, voice communication information, IP address and user personal information) at any time (a) to meet any applicable laws, regulations, legal procedures or government requirements; (b) Implement this clause, any agreement of Blizzard/Netease or relevant policies; (c) Protecting our legitimate rights and obtaining relief; When we think that someone's health or safety may be threatened; Or (e) reporting crimes or other misconduct.

Disclaimer. To the maximum extent permitted by applicable laws, Battle.net services are provided to you on an "as is" and "as is" basis, excluding any kind of guarantee (whether express or implied), including but not limited to merchantability, fitness for a specific purpose, ownership, non-infringement and various possibilities arising from trade practices. Netease and Blizzard do not guarantee that you can visit or use Battle.net service at the time and place you choose; There is no guarantee that Battle.net service will not be interrupted or error-free; There is no guarantee that defects will be corrected; There is no guarantee that neither the game client nor the Battle.net service contains viruses or other harmful elements.

Scope of responsibility; The only and unique compensation method; compensate

Blizzard and Netease are not responsible for the losses caused by your use of Battle.net service or your inability to use Battle.net service. Under any circumstances, Blizzard and/or Netease will not be responsible for the special, incidental, indirect, punitive or secondary losses caused by your use of Battle.net service, any game or any game client. In any case, Blizzard and Netease * * * will not be liable for compensation exceeding the total amount you paid to Blizzard and Netease six (6) months before the cause of action.

You confirm and agree that the only and only way to solve the dispute with Blizzard and/or Netease is to stop using Battle.net service and cancel all your registered accounts.

You agree to compensate and defend Blizzard and Netease for any claims, demands, damages or other losses (including paying reasonable legal fees) brought by a third party due to your use of Battle.net service or any game, violation of this clause, code of conduct and violation of the end-user license agreement of any game, and ensure that the interests of Blizzard and Netease are not infringed.

Dispute settlement and applicable law.

Disputes are expensive and time-consuming for all parties. In order to shorten the settlement time and reduce the settlement cost, you and Netease agree that any disputes, disputes or claims (collectively referred to as "disputes") concerning these Terms of Use will be negotiated informally for at least 30 days before being submitted to arbitration or litigation. The two sides will start negotiations when either party sends a written letter.

Binding arbitration. If both parties fail to settle the dispute through negotiation (excluding the following exceptions), you and Netease agree to submit it to arbitration. Both parties agree that China International Economic and Trade Arbitration Commission (hereinafter referred to as CIETAC) will conduct arbitration in Beijing, China in accordance with CIETAC's effective arbitration rules and applicable laws. The arbitral award is final and binding on all parties. Your arbitration fee and your share of arbitration compensation shall be borne by you.

Restrict. You and Netease agree that any arbitration is only applicable to disputes between Netease and you. You acknowledge and agree (1) that no one else will participate in any arbitration; (2) No right or authorization to conduct arbitration or use arbitration procedures; (3) There is no right or authorization to allow imaginary agents representing the public or others to raise disputes.

Exceptions to negotiation and arbitration. You and Netease agree that the following disputes are not bound by the above-mentioned negotiation and binding arbitration clauses: (1) any dispute that attempts to enforce or protect the intellectual property rights of you or Netease or Blizzard or related to the validity of intellectual property rights; (2) Any dispute about theft, piracy, invasion of privacy or unauthorized use, or disputes caused by these circumstances; (3) Request for lifting the ban. Such disputes shall be handled by the people's court with jurisdiction where Netease is located, and you and Netease agree to submit such disputes to the court for adjudication.

Applicable law. Unless otherwise specified, this clause is governed by the laws of People's Republic of China (PRC), and the principle of choice of law is not applicable. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded from the scope of application of this article.

General clause

Modification of the terms of use. These Terms of Use can only be modified by Netease and/or Blizzard in the form of written signatures or published by Netease on the official website of Battle.net.

Transfer. Netease can transfer all or part of this clause to any individual or subject at any time, regardless of your consent. Without Netease's prior written consent, you may not transfer your rights and obligations under this clause; Any unauthorized transfer is invalid.

Separability of clauses. If any content of this clause is deemed invalid or unenforceable, that part will be deleted and the rest will remain in full legal effect.

Attorney's fee. No matter which party initiates a lawsuit related to the Terms of Use, the winning party has the right to demand compensation from the other party for reasonable expenses, attorney's fees and other expenses arising from the lawsuit.

The whole agreement. This clause (including the documents explicitly quoted in this clause) constitutes the overall agreement between you and us, and supersedes all the contents of Battle.net Services (whether in electronic form, oral form or written form) that existed before or at the same time. However, this clause should coexist with the end-user license agreement of Blizzard Games and cannot replace the end-user license agreement and the special terms of use of the game.

Failure to waive our failure to enforce any clause in the Terms of Use shall not be construed as waiver of the present or future rights of the clause, nor shall it affect the right of either party to request the enforcement of the clause in the future. We clearly point out that giving up the provisions, conditions or requirements in the terms of use does not constitute giving up the responsibility of pursuing future compliance with such provisions, conditions or requirements.

Force majeure. Netease and/or Blizzard shall not be responsible for any delay or error caused by reasons beyond Netease and/or Blizzard's reasonable control, including but not limited to unforeseeable circumstances or unenforceable circumstances caused by reasons beyond Netease and/or Blizzard's control, such as force majeure, war, terrorism, riots, embargoes, civil acts or military incidents, fires, floods, accidents, strikes or shortage of transportation facilities, network interruption and fuel.

When you click the "Accept" button below or use the Battle.net service, it means that you have read and agreed to the terms of use, agreed to abide by the rules in the game, and understood and recognized our privacy policy.
