Three people commit a crime together. Can one of them apply for parole?

Yes, parole is a system in which criminals sentenced to fixed-term imprisonment or life imprisonment are conditionally released in advance after a certain term of imprisonment because they do show repentance and will not harm society. Parole shall be executed in accordance with the relevant provisions of the Criminal Law, and parole shall not be granted without legal procedures. The legal procedure for parole is:

A prison that implements compulsory labor reform shall submit a proposal for parole to the local intermediate people's court and submit the following materials:

1, criminal appraisal form;

2. Criminal reward and punishment table;

3. Judgments and rulings of the Court of Final Appeal;

4, a copy of the commutation ruling over the years;

5, criminals do have specific materials of repentance or meritorious service;

6, minors or elderly disabled (except self-injury, self-injury) materials.

Proposals for life imprisonment and parole shall be submitted to the judicial bureaus of provinces, autonomous regions and municipalities directly under the Central Government for approval before proposals for parole are made.

Second, after receiving the parole proposal from the prison, the intermediate people's court where the prison is located will review whether the materials are complete, the procedures are complete and the procedures are legal;

Three, the people's court shall, after examining the case materials, form a collegial panel to hear the case and order the criminals who meet the statutory conditions to be released on parole.

Article 79 of the Criminal Law of People's Republic of China (PRC)

The executing organ shall submit a proposal to the people's court at or above the intermediate level for commutation of the sentence of the criminal. When trying a case, the people's court shall form a collegial panel, and if there are facts of repentance or meritorious service, it shall make a ruling to reduce the sentence. Without legal procedures, the sentence may not be reduced.

Procedure for Parole Parole of a criminal shall be conducted in accordance with the procedure stipulated in Article 79 of this Law. No parole shall be granted without legal procedures.
