Article 40 of the Criminal Procedure Law stipulates that if the evidence collected by defenders shows that the suspect is not at the scene of the crime, has not reached the age of criminal responsibility, and belongs to a mental patient who is not criminally responsible according to law, he shall promptly inform the public security organ and the people's procuratorate. Accordingly, "evidence of traveling in other places at the time of committing a crime" belongs to the fact that the criminal suspect is not at the scene of the crime, and it should be informed to the case-handling organ in time.
The Decision of NPC Standing Committee on Revision was adopted by the 6th meeting of the 13th NPC Standing Committee of People's Republic of China (PRC) on1October 26th, 2008. It is hereby promulgated and shall come into force as of the date of promulgation.
