Article 1 In order to protect the legitimate rights and interests of rescuers, promote social integrity, and promote social harmony, these regulations are formulated in accordance with the basic principles of laws and administrative regulations and in conjunction with the actual situation of the Shenzhen Special Economic Zone. Article 2 The term "rescuer" as mentioned in these regulations refers to a natural person who voluntarily provides rescue to a person who has suffered personal injury or is in danger of personal injury in an emergency. He has no legal or agreed obligations. Article 3 The salvage party claims that the personal injury was caused by the salvage party and shall provide evidence to prove it. If there is no evidence or the evidence is insufficient to prove his or her claim, the person being rescued shall bear the adverse consequences in accordance with the law. Article 4 If the salvage party claims that the salvage party failed to pay reasonable attention to personal injury during the salvage process, it shall provide evidence to prove it. If there is no evidence to prove or the evidence is insufficient to prove his claim, the person being rescued shall bear the adverse consequences in accordance with the law. Article 5 If the rescued person fabricates, falsely accuses or frames the rescued person and incurs expenses, the rescuer shall have the right to recover compensation from the rescued person in accordance with the law. Article 6 If the rescued person fabricates facts and makes false accusations against the rescuer, thereby constituting a violation of public security management regulations, he shall be subject to administrative penalties in accordance with the law; if it constitutes a crime, he shall be held criminally responsible in accordance with the law.
If the rescued person fabricates facts and falsely accuses the rescuer, the rescuer may file a civil lawsuit with the People's Court and require the rescued person to bear civil responsibilities such as apology, compensation for losses, elimination of influence, and restoration of reputation.
If the rescued person falsely accuses the rescuer, the case-handling agency shall notify the public credit reporting agency of the results within 15 working days from the date when the legal document takes effect, and enter it into the personal credit record system. Article 7 If a unit or individual who understands the rescue situation provides legal and valid evidence to prove the rescuer's rescue behavior, the relevant departments shall reward the witness in accordance with regulations. Article 8 If the rescuer requests legal aid due to a civil rights dispute between the rescuer and the rescued party, the legal aid institution shall provide timely assistance. Article 9 Rewards and other protections for those who act bravely for righteousness shall be implemented in accordance with the provisions of laws and regulations related to righteousness and bravery. Article 10 These regulations will come into effect on August 1, 2065438.
