Notice on Adjusting the Standards of Funeral Allowance, One-time Pension and Survivor's Living Difficulties Allowance after the Death of Enterprise Employees (No.40 [2002] of Lao She)

According to the spirit of the relevant documents of the national and provincial labor and social security departments, with the consent of the municipal government, it is now decided to adjust the standards of funeral subsidies, one-time pensions and subsidies for survivors' living difficulties after the death of enterprise employees (including retirees, the same below) as follows:
I. Funeral allowance
In case of death due to illness or non-work-related, pay the average salary of employees in the previous year for 3 months; In case of work-related death, the average salary of employees in the previous year shall be paid for 6 months.
Second, one-time pension.
In case of death due to illness or non-work, the average salary of employees in the previous year 10 month;
In case of work-related death, pay the average salary of employees in the previous year for 48 months; If a disabled person who is rated as 1-4 disabled due to a work-related injury dies while enjoying the disability pension, the average salary of employees in the previous year will be paid for 24 months.
Three, the main living difficulties of survivors subsidies.
In case of death due to illness or non-work-related reasons, 25% of the average salary of the enterprise in the previous year will be paid per person per month; To support 3 or more people (excluding children with super family planning), the subsidy standard shall not exceed 70% of the average monthly salary of local enterprises in the previous year.
In case of work-related death, the spouse shall be paid at 40% of the average monthly salary of employees in the previous year, and other dependent survivors shall be paid at 30% of the average monthly salary of employees in the previous year; If the spouse or other dependent survivors are widowed old people or orphans, they can be increased by 10% on the basis of the above standards, and the total amount of subsidies for survivors' living difficulties does not exceed the deceased's salary.
Four. any other business
(1) In the future, funeral subsidies for enterprise employees, one-time pensions and subsidies for survivors' living difficulties will be adjusted year by year according to the above provisions with the economic development and changes in employees' wages. (two) after the death of retirees who have participated in the basic old-age insurance, the above expenses shall be paid from the old-age insurance fund; After the death of employees who did not participate in the basic old-age insurance unit and those who participated in the basic old-age insurance unit, the above expenses shall be paid by the unit.
(three) institutions that have participated in the basic old-age insurance shall refer to the above standards.
(4) This article shall be implemented as of the date of issuance. Previously, if the deceased employee supported his survivors and still met the support conditions, the living hardship allowance would be implemented according to this article, and the past one would not be reissued.
(five) Caidian, Jiangxia, Huangpi, Xinzhou, Dongxihu, Hannan District, can refer to the above provisions, combined with local conditions, formulate specific standards.
