Correctable Evidence in Criminal Cases

Legal analysis: According to the relevant laws and regulations of our country, the evidence in public prosecution cases is provided by the procuratorate. Therefore, if the case requires supplementary evidence, the procuratorate is responsible. The People's Court does not need to supplement the evidence.

Legal basis: Article 204 of the "Criminal Procedure Law of the People's Republic of China" If any of the following circumstances affect the trial, the trial may be postponed: (1) New witnesses need to be notified to appear in court, and New physical evidence, re-identification or inspection; (2) The prosecutor finds that the public prosecution case requires supplementary investigation and makes suggestions; (3) The trial cannot be carried out due to application for recusal.
