2. If the defendant actively compensates the victim for the loss and obtains the victim's understanding, the court may appropriately give a lighter punishment when sentencing.

Article 225 During the trial, the court shall investigate the facts and evidence related to sentencing.
In addition to examining whether the defendant has statutory sentencing circumstances, the people's court shall also examine the following circumstances that affect sentencing according to the circumstances of the case:
(a) the cause of the case;
(two) whether the victim is at fault and the degree of fault, whether he is responsible for the intensification of contradictions and the size of the responsibility;
(three) whether the close relatives of the defendant assisted in the capture of the defendant;
(four) the defendant's usual performance, whether there is a guilty attitude;
(5) Returning stolen goods and making restitution;
(six) whether the defendant has obtained the understanding of the victim or his close relatives;
(seven) other circumstances that affect sentencing.
