What are the norms for lawyers to handle criminal cases?

All china lawyers association recently promulgated the Code for Lawyers Handling Criminal Cases, which clearly stipulates lawyers' participation in criminal proceedings.

The norms are clear, lawyers participate in criminal proceedings, perform their duties of defense and agency according to law, and their personal rights and professional rights are inviolable. Lawyers' opinions of appearing in court to defend and represent in criminal proceedings are not subject to legal investigation except those that endanger national security, maliciously slander others and seriously disturb the court order.

The Code points out that lawyers should abide by laws and regulations and abide by lawyers' professional ethics and practice discipline when participating in criminal proceedings; In defense activities, lawyers should be based on laws and facts, respect the opinions of the parties, work in accordance with the principle of benefiting the parties, and may not put forward defense opinions against the wishes of the parties.

According to the professional discipline stipulated in the standard, lawyers are not allowed to meet the staff of the case-handling organ in violation of the regulations and ask the handling opinions of the case-handling organ, and they are not allowed to use their special relationship to influence the handling of cases according to law; Do not gather people to make trouble or create influence by illegal means that disturb public order and endanger public safety.

The Code has also formulated nine rights relief clauses to protect lawyers' right to practice normally. For example, if a lawyer believes that the case-handling organ and its staff have committed one of the 16 acts of illegally preventing defense lawyers from consulting, extracting and copying case files, they may appeal or accuse to the people's procuratorate at the same level or at the next higher level.

On the one hand, lawyer norms protect lawyers, on the other hand, they also restrict lawyers' behavior.
