Summary of the work of the department of industrial and commercial administration regulations

Since the beginning of this year, our department has conscientiously studied and understood the spirit of the 18th CPC National Congress and the spirit of the National Conference on Industrial and Commercial Administration. With the goal of solidly promoting the construction of business under the rule of law, we carefully plan the legal work of the province's industrial and commercial system, strive to improve the quality of system construction, strengthen law enforcement supervision, resolve administrative disputes according to law, innovate administrative law enforcement mechanisms and methods, and do a good job in legal publicity and education. The main situation is as follows:

First, strengthen organization and coordination, and promote industrial and commercial construction under the rule of law.

1. Carefully deploy the legal work of the province's industrial and commercial system in 20 13 years. Combined with the implementation of "Fujian province 20 13 plan to promote the construction of a government ruled by law" and the deployment of the province's industrial and commercial administrative work conference, the system-wide legal work in 20 13 was carefully planned, and the legal work points of the province's industrial and commercial system in 20 13 were issued in time to strengthen the guidance of the system-wide legal work.

2. Conscientiously implement the State Administration for Industry and Commerce's "Evaluation Index System for Rule of Law in Industrial and Commercial Administration Organs". Combined with the performance evaluation requirements of the provincial government, the specific evaluation indicators for the construction of industry and commerce under the rule of law were set in the Detailed Rules for the Performance Evaluation of Industrial and Commercial Bureaus of Districts and Cities by the Provincial Industrial and Commercial System, and the performance evaluation mechanism for promoting the construction of industry and commerce under the rule of law was continuously improved. At the same time, combined with the reality of the construction of the rule of law industry and commerce in our province, we carefully studied the work plan of the evaluation index system of the construction of the rule of law industry and commerce in our province, put forward detailed indicators, and promoted the implementation of the work.

3. Conscientiously implement the administrative guidance rules of the State Administration for Industry and Commerce. At the end of March this year, our bureau formulated and promulgated the Implementation Opinions of Fujian Provincial Administration for Industry and Commerce on Implementing the Administrative Guidance Rules of the Administration for Industry and Commerce, and put forward specific work opinions and requirements to effectively promote the administrative guidance of the industrial and commercial system in the whole province.

4. Continuously enhance the effectiveness of legal publicity and education throughout the system. Edited and distributed Fujian Legal Newsletter 10, Administrative Guidance Briefing 16 (64 articles), submitted 45 pieces of information in the column of "Industry and Commerce Insider", and submitted legal work information to publications and information platforms at all levels in time, which was adopted by the Legal Newsletter of Industry and Commerce Administration and the Legal Information of Fujian Government in the first half of the year. The legal information submitted by our bureau and other three provincial departments in 20 12 was praised by the Legislative Affairs Office of the provincial government.

5. Strengthen system-wide legal professional training. On June 3-7, 20 13, the legal business training and administration according to law training of the province's industrial and commercial system were organized, and 73 legal department heads or business backbones participated. At the same time, it also actively cooperated with the People's Education Department and the Competition Law Enforcement Department of the Provincial Bureau to prepare and implement the training of key law enforcement personnel in the province 100.

6. Organize the revision of some laws and regulations commonly used in grass-roots industrial and commercial administration. According to the needs of grass-roots law enforcement, on the basis of extensively soliciting opinions from grass-roots units, it took half a year and four drafts were changed, and 152 commonly used laws, regulations and rules (including 22 amendments, 36 additions and 8 deletions) were compiled into a book with about 950 pages. Now it has been printed and bound, and it is planned to be distributed to grassroots units in the near future.

7. Organize the summary and acceptance of the "Three Five-Year Plans" and the mid-term supervision of the "Sixth Five-Year Plan". Issued the Notice of Fujian Provincial Administration for Industry and Commerce on Organizing the Summary and Acceptance of the Third Five-year Plan and the Mid-term Inspection and Supervision of the Sixth Five-year Plan (Fujian Industrial and Commercial Law [2013] No.271), earnestly organized and carried out the summary and acceptance of the Third Five-year Plan and the Mid-term Inspection and Supervision of the Sixth Five-year Plan, and further promoted the Third Five-year Plan.

Two, the introduction of policies to support development, strengthen the construction of law enforcement system.

8. Do a good job in organizing and coordinating the formulation of comprehensive policies and measures. In conjunction with relevant departments and relevant district and municipal bureaus, several opinions of Fujian Administration for Industry and Commerce on supporting and promoting the development and growth of small and medium-sized enterprises in Zhangzhou (Min Gongshang Ju [2013] No.2) and Several Opinions of Fujian Administration for Industry and Commerce on supporting the comprehensive reform of Quanzhou's financial services real economy and the construction of a comprehensive supporting reform pilot zone for private economy (Min Gongshang Ju [2013] No.5) were formulated. Organize the formulation and revision of 35 laws, regulations and rules, such as the Measures of Fujian Administration for Industry and Commerce for Standardizing the Discretion of Administrative Punishment, and the first draft has been formed. At present, two stages of work have been completed: division of labor, investigation and revision, and centralized discussion and revision, and opinions have been sought throughout the system. Organized and carried out the revision of the Catalogue of Administrative Compulsory Powers, and now it has formed the first draft, and solicited opinions from the whole system.

10. Implement the Measures for the Administration of Normative Documents of Fujian Administration for Industry and Commerce. In accordance with the requirements of the Measures, we will continue to do a good job in reviewing, publishing, filing and cleaning up normative documents. In the first half of the year, a total of 7 normative documents of provincial bureaus were reviewed (5 of which have been officially promulgated), and the normative documents submitted by XX Bureau were put on record for review 1 piece.

Issued the Circular of Fujian Provincial Administration for Industry and Commerce on the 20 12 Annual Law Enforcement Inspection of the province's industrial and commercial system, and participated in the national industrial and commercial system law enforcement inspection report meeting held by the General Administration.

14. continue to strengthen the qualification management of law enforcement subjects. Complete the 20 13 provincial government administrative law enforcement qualification examination professional legal knowledge papers and related examinations; Do a good job in the daily application and renewal of administrative law enforcement certificates of relevant personnel.

15. further promote the standardization of the work of "connecting the two methods". Forward the opinions of the Supreme People's Procuratorate, the Ministry of Public Security and the State Administration for Industry and Commerce on strengthening the connection between industrial and commercial administrative law enforcement and criminal justice, and inform the XX Municipal Administration for Industry and Commerce of the practices and experiences of strengthening the connection between the two laws, strengthening the guidance and supervision of case transfer, and striving to prevent law enforcement risks.

16. Go to the grassroots to investigate the practices and experiences of case review in grassroots legal institutions, strengthen the research on law enforcement and case handling, and promote law enforcement supervision.

17. On the basis of in-depth investigation at the grass-roots level, collect relevant information and solicit opinions from relevant departments. Begin to study and formulate measures for the administration of public lawyers.

18. Seriously accept and handle all kinds of cases. Handling 20 applications for administrative reconsideration, closing 13 cases (maintaining 10 cases, terminating/kloc-0 cases, the applicant giving up 2 cases), transferring/kloc-0 cases, and 6 cases are pending; There were 5 administrative litigation cases, the court rejected the plaintiff's claim 1 case, and 4 cases were pending; There are 1 cases in administrative reconsideration, and the trial was terminated because the parties withdrew their applications. Held four hearings on administrative punishment cases of provincial bureaus; Examined 1 14 cases of administrative punishment by provincial bureau (including 79 cases filed, 26 cases of foreign investment, 8 cases of corps, and 1 case of enterprise supervision).

19. Strengthen the guidance and standardization of system-wide reconsideration litigation. Complete the statistical analysis of the system-wide reconsideration litigation cases in 20 12, and issue a document to the whole system. Strengthen the research on reconsideration cases of letters and visits, and strive to change from simply handling reconsideration litigation cases to paying equal attention to handling cases and guiding and supervising, and strive to effectively prevent or reduce the occurrence of administrative disputes by handling cases, guiding and standardizing a class of behaviors.

20. Explore and improve the collective deliberation system of provincial bureau cases. According to the spirit of the situation analysis meeting of the Party's work style and clean government construction of the provincial bureau, the working mechanism and system of the case evaluation meeting of the provincial bureau will be revised and improved in conjunction with the competition law enforcement department and the inspection corps of the provincial bureau, and the collective evaluation system of major and difficult cases will be further improved. Understand and master the operation of collective deliberation of grassroots cases through written solicitation of opinions, on-the-spot investigation and research; Study and draft the relevant work system of collective review of cases in provincial bureaus and form the first draft to solicit opinions extensively, so as to promote the construction of internal control mechanism of administrative law enforcement quality, further standardize industrial and commercial administrative law enforcement behavior and effectively prevent law enforcement risks.

2 1. Participate in the development and demonstration of case management system. Cooperate with competition law enforcement departments to do a good job in the development and demonstration of Fujian industrial and commercial system economic illegal case management system and the granulation of laws and regulations.

According to the deployment of the provincial industrial and commercial administration work conference and the provincial party work conference, the party committees of government organs thoroughly studied and implemented the spirit of the 18th Party Congress, continuously deepened the "three-level joint creation" activities, comprehensively strengthened the party building in government organs, carried out the party's mass line education and practice activities in depth, made great efforts to improve the scientific level of party building, and provided a strong guarantee for the work around the overall situation and service centers.
