(1) Lawyer file transfer procedures
If a lawyer practicing outside Shaanxi Province intends to be transferred to our firm to engage in legal work, he should first transfer his lawyer's practice files. After entering Shaanxi, follow the relevant regulations.
The following materials must be submitted for the transfer of lawyer’s practice files:
1. Two original copies of the lawyer’s file transfer application form.
2. The original application form must be submitted in duplicate, including: name, ID number, lawyer practicing license number, and where to transfer the application. The signature must be stamped with the official seal of the unit (the law firm to be transferred).
3. Two copies of the applicant’s ID card.
4. Letter of introduction issued by a practicing law firm.
(2) Lawyer case file transfer procedure.
If our city’s lawyers are transferred to practice outside Shaanxi Province or no longer engage in the legal profession, they must apply for cancellation of their lawyer practice license. If you need to transfer your personnel files and practice files outside the province, you should submit the following materials:
1. Two original copies of the lawyer file retrieval application form.
2. The original application must be made in duplicate, including the applicant’s name, ID number, practice license number, practice experience, my application for cancellation of the lawyer’s practice license, and my application for access to personnel files and practice files. reasons and where to transfer the application.
3. Two original copies of the resignation certificate issued by the original law firm, including: the applicant's work performance, whether there has been any violation of lawyer's professional ethics and practice discipline, etc. The business and financial procedures between the applicant and the original practicing law firm have been settled. The two parties have terminated the labor relationship and agreed to hand over the personnel files and practice files.
4. Two copies of the applicant’s ID card.
5. Original lawyer’s practicing certificate.
6. Letter of introduction issued by a practicing law firm.
2. Process
1. The applicant submits application materials for a practicing license to the Lawyer Affairs Section of the Municipal Justice Bureau. Preliminary review and acceptance personnel:
(1) If the application materials are complete and comply with the legal form, they will be accepted;
(2) If the application materials are incomplete or do not comply with the legal form, they shall be accepted on the spot. Or inform the applicant of all the content that needs to be supplemented and corrected within five days from the date of receipt of the application materials. If the applicant makes corrections as required, the application shall be accepted; if the applicant fails to notify the application within the time limit, the application shall be accepted from the date of receipt of the application materials.
(3) If the application matters obviously do not meet the statutory conditions or the applicant refuses to make corrections or cannot make corrections to relevant materials, the application will not be accepted and the reasons will be explained in writing to the applicant.
2. The accepting personnel will complete the preliminary review of the application materials from the date of acceptance, and submit the filing opinions and all application materials to the Provincial Department of Justice.
